Another person from my k1 group was transferred to csc and after waiting 7 months they just got an rfe about medical records. Bleh.

Which is absolutely NUTS because their medical examination has most probably expired by that point.

This is the sort of carry-on I find irritating about the process and I would argue means someone didn't do their job properly. USCIS need time to get through the large pile of paperwork that they have, fine. That's not the issue. But the USCIS should have cut-off points that are 'tough poop to you, Mr/s. Adjudicator' if they fail to request anything that's missing within a certain timeframe. How is it right that someone has 6 months to use a visa, about 3 months to meet the conditions of said visa and then wait 7 months to be asked for documentation that could well have expired 5 months prior to the request?

I was just wondering does anyone got a similar RFE, and how they handled it? is there anything that I shouldnt be doing?

Each Adjudicator has a list of RFE sentences they can stick into their RFE processor, if you will. Some share, and I'd guess others don't ask :D This means they don't always ask for things as clearly or exactly as they should.

I think upon closer reading, that you may have only sent the actual return and not the supporting documentation? They asked for a 'complete' return, so that would include his W-2. This is why they prefer transcripts. Lighter, quicker to reference and doesn't require the supporting paperwork.

You've explained that your household is made up of only the 2 of you and that the USC has not claimed any other dependents on their 2009 return.

Is the $49,000 you've listed as his 2009 income made up of salaried income alone and is it only the USC's income?

Did you submit Each part of his 2009 return, including copies of his W-2?

Did you submit any other documentation showing his actual recent 2010 income?

You're not actually required to send 3 years' returns any more, but you do need proof of recent income like pay stubs. You're not required to file your 2010 tax return yet, but you might be asked to update their records with it by the time interview rolls around.

I wouldn't cloud the situation with a new I-864, if you believe the original one was accurate.

In summary, I would send:

2009,2008 and 2007 transcripts you've ordered

2010 W-2/s

6 months of paystubs

Detailed letter from current Employer confirming employment details, dated within 3 months of submission.

Covering letter listing everything that you are including to evidence your ability to sole- support.

K-1/K-2 NOA1 - POE: 9 February - 9 July 2010

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Problem is the application probably wasn't actually sitting on any adjudicators desk, but in a box off somewhere untouched. What they really need is a better filing system. And if they fail to get to your paperwork before the things you submitted have expired, then you darn well shouldn't be RFE'd. :bonk:

I received exactly the same text as well. Although I was out having dinner & a drink I didn't find it till this morning. I'm hoping they're not bothering with the EAD/AP & just processing the GC for a quick approval.

Planning to call on Monday to find out what it really means, seems odd to have to notifications in one week. Also said on my hard copy that there was a premium 15 day application, & to call if the centre is showing outside of national average wait times (I-485 in CSC is showing as 16 July 10).

This has got to be a good thing!! :thumbs:

i recieved my biometrics appointment today and will b on feb 23 and also recv a transfer notice for my I-485 suck is my A# of my I-485 is wrong i already called them about it when i was rececieved my noa hardcopy i noticed tht my A# is wrong so i called them right away and then they told me they will fix this problem.then now as i noticed its the same A# on my NOA its the wrong one i guess need to call them again grrrrrrrrrrrr

Oh jeeze well that sucks. At least things are moving along. Just keep calling and make them fix their mistake! It will work out :)

Timeline

A couple days after I whined about not receiving my husband's bio appt, we got the letter in the mail. :blush: Ended up getting it about a month and a half after they received our application. We did a walk-in a couple weeks before the date, because he was scheduled to work that date, and they let him do it. We have gotten lucky twice now with walk-in biometrics, because I have seen them turn other people away.

Our issue now is that my husband's K3 visa expires June 23 2011, and the USCIS office we're going through is only currently at least six months behind. Which means we're going to have to pay for the K3 extension, which is $290... which will be a total waste if he's approved before his visa expires. It beats the GC process being delayed and his visa expiring, though!

As I had just got into the 30 day period for 765 & 131, along with bio for 485, she put in a request for action (I think) on all 3 cases. Sadly that means if I haven't heard anything in 30 days I need to call back, but fingers crossed that the request kicks it into action.

Anyone else have any thoughts or info that sounds similar?

As I had just got into the 30 day period for 765 & 131, along with bio for 485, she put in a request for action (I think) on all 3 cases. Sadly that means if I haven't heard anything in 30 days I need to call back, but fingers crossed that the request kicks it into action.

Anyone else have any thoughts or info that sounds similar?

Unfortunately service requests do have a window of 30 days in which action can be taken, but hopefully something will happen sooner for you :)

Personally I think you are a bit early with a request for action only into the 30 day period. Its averaging about 70 days for EAD/AP and X amount of time for AOS.

But good luck, I hope it moves things forward quicker for you.

Nooooooooooooo whistling.gif They did accept my RFE return so I'm back in processing, but that was a week ago and nothing since. Rubbish. So maybe I'm destined to go the interview route, which is scary but on the upside once you get your interview date you have a firm idea of when you are likely to be approved :)

Keeping myself busy expanding my culinary horizons at the moment! Hubby is doing Weightwatchers at the moment and his parents are out of town so I actually get to cook for a change, so been trying all these 'healthy' recipes out. Turns out I make a mean low-fat chicken parm!

Im struggling a bit with American home cooking. Eating out is OK but some of the stuff at home is just damn odd.

My wife's cooking is a brilliant mixture of what I like and her American upbringing but her mothers cooking is through and through old style

cooking. I have never see so much butter, salt, sugar used in cooking. No wonder out adopted nation has a slight weight issue.
