Just got notified that we've received an RFE- this is what it looks like for anyone that's interested!

Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Your Case Status: Request for Evidence

On January 25, 2011, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

A request for evidence is made when an application/petition is lacking required documentation/evidence (initial evidence) or the officer needs more documentation/evidence (additional evidence) to determine an applicant's eligibility for the benefit sought. We may send you a request for evidence at any stage of our review. The request will indicate what evidence or information is needed for us to fully evaluate your application or petition. The notice will explain where to send the evidence and will give the deadline for your response. Your application or petition will be held in suspense during that time. If you receive a request for evidence and have questions about what you need to submit, you may call our National Customer Service Center at 1-800-375-5283.

11/11/2008 - I-129F Sent

11/13/2008 - I-129F NOA1 issue date

11/17/2008 - Received NOA1 hard copy in the mail

1/23/2009 - Received email stating I was approved (NOA2) on 1/22/2009

1/26/2009 - Recieved NOA2 hard copy in the mail

4/29/2009 - Embassy interview date - was put into AP (given a form with 221(g) box checked)

12/25/2009 - Still stuck in AP- almost 8 MONTHS and counting... :(

12/28/2009 - Embassy finally called my gal for another "interview"

1/14/2010 - VISA APPROVED at the second interview- took about 8 1/2 months of AP

1/21/2010 - Visa delivered by courier- BUT, she opened sealed envelope that was for U.S. Immigration at POE.

Now embassy in Bogota wants us to do the medicals all over again.... nightmare continues.....

2/22/2010 - She went back to Bogota to get labs and medical re-done. Then back to embassy where they finally

re-issued the visa. Is valid until July 13th

7/3/2010 - She made it to the U.S. finally!!! I filed on November 11th 2008 and went thru 8 1/2 months of AP

12/16/2010 - Sent in packet by Fed Ex to Chicago

1/7/2011 - Notified by email from USCIS packet was received

1/25/2011 - Notified by email we are receiving an RFE

2/4/2011 - Sent translated birth cert in (RFE)

2/9/2011 - Biometrics done

3/1/2011 - EAD/AP card received

just got txt and email from uscis tht my case transfered to california service center,its make me happy tht i heard something about my aos,even i dnt recieve my biometrics appoinment yet.still dnt have any touch on my ead and ap.last touch dec 24

Ok just got back from Norfolk VA for my biometric appointment. Got there at 10am instead pf 11am. Place was empty. In and out in 10 minutes.

I travelled down last night. (3 hour car trip). Hotel stay and car trip back up this morning after appointment.

Hmmmmm! I wonder if I can claim my expenses back from USCIS...............Nah.

Question:

I am nearly 100% sure that when I did my entry to the US, the officer took my fingerprints. Every time I've traveled into the US they do this.

I still haven't received my bio appointment & we are approaching the 30 day limit USCIS says you need to reach before you can call to get an idea. Would my fingerprinting at POE count as my biometrics or not?

Just curious as had the case transferred on 24th & the post today has revealed no hardcopy in it, super frustrating to not see anything.

Just did my biometrics yesterday and it includes all fingers, while the airport customs the fingerprint is usually the thumb only :)

Yep, POE fingerprinting doesn't count as biometrics. The bios they take on the day are far more precise, plus they take pretty much everything save your inside leg measurement!

Once you hit 30 days, call USCIS. You've already been transferred to CSC, right? (Sorry, can't see timelines, I'm on my blackberry :) so you know stuff is happening, it just might be your local office is horribly backed up :)

Sorry that I'm Late !!!! AOS packeage sent on 23 December, received by the USCIS - Christmas eve.

NoA 1 on the I-485 and I-765 received 0n the 13th? I think. Biometrics scheduled, did them yesterday at the Seattle USCIS office in Tukwilla, (26 january 2011). Last thursday (20 january) my husband got a text about RFE being sent our way.Just received the copy last night. the RFE is about the Affidavit of support mainly and here is what it says:

* Submit a complete Federal Income Tax Return submitted to the IRS from the petitioner( sponsor) on form I-864 , afidavit of support for the mosr recent tax year/ well SORRY FOR THE CAPS, BUT WE HAVE SUBMITTED INITIALLY THE FORM NEEDED WITH THE AFIDAVIT OF SUPPORT B-U-T;we submitted tax returns from 2009, 2008, and unfortunately 2006. I did a research and having an RFE in January/Feb about your tax form for the most recent year does not mean you have to submit a form that you dont have (like the W2 from 2010, right now) they just want a consistency of 3 consequential years. To order a transcript from a previous year from the IRS is fairly simple, we ordered it through the phone, and I think its free (the girl on the phone explained that a lot of people right now are asking copies from their previous years tax returns for immigration purposes this period of the year.) . so our 2007 W2 will be coming soon in the mail and we are gonna send it with coppies from all the 4 consequential years. ( if anyona else has a different experience with this type of RFE and we are wrong please write me ASAP!!! I dont wanna screw up!!!!

* The petitioner/ sponsors income on the tax return DOES NOT MEET or exceed 125 percent of the poverty guideline (well sorry but again I have no idea what this is : our house hold income for 2 member family is around 49000 $ per year and the guideline is like 18000 or sth)The petitioner/sponsor lists their current income as sufficient, however no evidence has been submitted as proof of current income ( we actually did but the letter from the employer was just short and didnt contained the details that they are listing after this statement)

Please submit evidence of the petitioner/sponsor's income. Such evidence should include:

- Letter of employment CONTAINING THE FOLLOWING:

Dates of employment ( we had that contained in the previous employment letter)

Nature of Job (also contained previously)

Wages or Salary earned ( also contained)

Number of hours per week worked (also)

Prospects for future employment and advencment (??????????? Did anyone had this we didnt)

Pay stubs or other documentation of pay for the previous 6 months ( my husbands work doesnt actually have pay stubs, but well we requested them yesterday)

Evidence of other income, such as Tax exempt interest, Qualified Dividends, IRA distributions, Pension, Annuities and Social Security Benefits (only SSA-1099 and or SSDI -1099)

* BASED ON THE DOCUMENTS The petitioner/ sponsors income on the tax return DOES NOT MEET or exceed 125 percent of the poverty guideline for the household (#######??? again ) Submit evidence of assets that meet the standards listed below or obtain joint sponsor.

Ok I get this, but we didnt fill out the part 7 of the affidavit of support cause the part where you are listing your assets was optional as long as you have te sufficient funds to support your household and now they are asking us for it? Dunno whats up with that but I am wondering should we prepare a WHOLE NEW AFFIDAVIT OF SUPPORT with a brand new documents and send it to them, cause I dont see how you can send a half form?

Does your spouse have any children that do not live with them? Did you get joint sponsorship from someone living at the same address? In either case you have to include them in your household size. Example: my husband has a daughter from a previous marriage. Even though she lives with her mother elsewhere, she still has to be included in our household. Because we currently live with his dad, who is co-sponsoring, he is also included in household size. So even though there's only 2 of us, our household size for USCIS purposes is 4, and therefore the poverty threshold is higher. Bear this in mind and read the I-864 instructions carefully, in case you've missed something.

If you can get a more detailed letter from your spouse's employer I suggest doing this also. The more evidence you can give the USCIS the better.

It is difficult to judge in these situations without knowing the details of your case - however if you are adamant you meet the thresholds I suggest you call USCIS to query the RFE - let's face it, USCIS getting it wrong is hardly unusual ;)

Another path you might consider is getting a joint sponsor so you have all bases covered, but this isn't an option for everyone.

I have a hypothesis in relation to AOS of K1 visa holders and being sent to CSC.

I think the AOS is checked for completeness, accuracy at the NVC. If it fails that check an RFE is sent out. Once it passes this check it is then checked to see if it can be adjudicated without interview. If they think it can they send it to CSC, if not it is sent to your local USICS office.

So I wonder have they pretty much made up their mind at the NVC? Is the CSC just used to rubber stamp approval and maybe just catch somethingthey have missed?

Thanks for the response, MIss Jess!!!. Neither I nor my husband have children, and we are living just by our selfs, no one else. But thank you for answering. I called the Uscis this morning, and as you probably already know they werent really helpfull. I like having control over my situation so we already sent out requests to emplyer, IRS, Bank for the needed documents.I was just wondering does anyone got a similar RFE, and how they handled it? is there anything that I shouldnt be doing? and as MIss Jess saing: Uscis making a mistake it hardly unusual:D:D:D:D Hope none of you has an RFE, and everything goes smooth to you and your spouses, family members etc!!!!
