maybe your friend can get a visiters visa and go visit him. then file for the fiancee visa. are they engaged yet?

Hi everyone,

I'm asking on behalf of a friend who.

My friend lives in Jamaica and has been talking to this guy she met online for about a year now. He cannot travel due to child support issues and so they are thinking about doing a fiance visa but they have no pictures together or any form of evidence that they're truly together. They talk on the phone every day and he sends her money which she keeps the recipt for but she's afraid it might be enough so she needs some advice as to what to do. Should she talk the chance with the fiance visa?

As people have already mentioned, one of the requirements is for the petitioner to have met the beneficiary, in person, within the last two years of filing the fiance(e) visa petition. Your USC female friend has not yet met this person, yet she is sending money to him? :wacko: Please advise your friend to look up the definition of the "sanky panky." I am concerned with your friend's situation and truly hope she is not being used. Also, wouldn't she want to actually MEET the person she is thinking now she would like to marry? :whistle: Best wishes to you and your friend!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

See bold above. It is not true that having a passport revoked for child support arrears will disqualify a sponsor. As you well know, debts are not considered unless there's an IRS lien. I'm intimately acquainted with a case where the petitioner's passport was revoked after the meeting and marriage and was still revoked when the I-864 was executed and visa issued. Shortly thereafter the child support was caught up and all is well. The petitioner is an honorable mane who manages money well but fell behind due to a 90 six month period of layoff. He paid, but not in full and California has a $1,000 threshold instead of using the higher federal one.

Unpaid taxes are only an issue if the IRS has invoked a lien and you cannot show you've made and are keeping a payment arrangement.

None of this applies to the case in question at this point because they haven't met in person. I'm just correcting incorrect assertions.

I stand corrected on my choice of words for the tax issue, yes, a lien must be in place. "Un-paid taxes" is too broad a statement. Also they would not necessarily disqualify someone but the amount of a tax lein will be deducted from ones income for qualification purposes and CAN cause a person not to qualify.

I had understood the same thing was in place for child support in arrears to the point that passports were revoked. If that is not true I stand corrected.

All that said, they STILL have to meet in person and given the difficulty of getting visas in Jamaica, my advice remains the same

1. Get the child suppot caught up

2. Get a passport

3. Go to Jamaica and meet

4. File for the K-1

Ooopss... Just realized that your female friend is the Jamaican (potential beneficiary). I am sorry. Still, her man would have to go to Jamaica and meet her in person. I think there is a similar term as "sanky panky," but for females "sankette," maybe? Anyways, I wish you all the best.

Thanks for all the replies. You guys "crack-me-up" no offense. I'm not sure how this child support thing works or what exactly the issue is but I'll surely ask her. I for one doesn't trust him, there's something sketchy about him based on how she talks about him. I've told her to check him out first (background check) to make sure he is who he say he is but she seems pretty content. She would need a visa to go to mexico and P.R She did say something about him not being able to get a passport and he was locked up for child support or something to that effect.

Well, I am glad you seem to have the "sense" that your friend doesn't seem to have. Honestly, talk to your friend. Explain to her that past behavior is a good predictor of future behavior. If their "relationship" continues, what will guarantee that she will not have children by him who will not be taken care of (just as his own children are not taken care of by him)? And, as other members have mentioned, why not pay for his child support instead of sending money to your friend, a foreign woman he has never met?

b) USC male goes to Jamaica, meets friend, files I-129 F.

c) USC male goes to Jamaica, marries your Jamaincan female friend, and files I-130.

I agree with Crossed_Fingers, if you don't have money to pay for your child how the heck you going to have money to send to a female. He needs to get his priorty straight. Why do your friend wants to get with someone that doesn't like to take care of his repossibility.

Easy ticket out of Jamaica.. hmmmmmmm who wants to marry someone they have neve-r met in person... hmmm a desperate one... but she was advise dof the i-129f even though the basic requirements cant be met
