Hello everyone,

My name is Andrew, I live in Florida and have recently married in China. I submitted form I-130 a couple of weeks ago and just received the email notification that my application was received and transferred to the California processing center. I am now awaiting NOA1 in the mail and was planning to submit the I129F for a K3 visa for my wife. After hearing about the improvements made in processing time for the CR1 visa, I question if I should at all apply for the K3 visa. According to the USCIS website, a fee is no longer required for the I129F, so there is no extra cost for that application. Under the circumstances, would the safer thing be to apply for the K3 visa with the understanding that if the CR1 was approved first the K3 would be cancelled?

Another consideration I have is that I stated on my G325 biographical that I intended to apply for a K3 visa. If I were now to abandon the I-129F application, would my I-130 be processed as it would have had I not stated that my intention was to apply for a K3 for my wife? Thanks in advance for your advice.

The K-3 is administrativly closed at the NVC, you will follow the CR-1.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

USCIS doesn't issue visas. My advice is to make your plans as if the K3 visa doesn't exist, because effectively it died 2/1/2010. It was killed by the Dept. of State's National Visa Center. Note: Dept. of State DOES issue visas, just not the K3 anymore.

Thanks for the warning.

On the G-325a I did not select "Status as Permanent Resident." I selected "Other" and stated that I would be submitting an I-129F for a K-3 visa. So what to do; go forward with the I-129F application or inform the USCIS that I have decided not be submit an I-129F after all? How would I go about informing them? Is there a chance that informing them would cause confusion and possibly hold up the process?
