Hello,

The Gov site for info on how to complete the I-864 is pretty detailed yet I still can't find all the info I need to include to prove my self employment income. I have had my business for 3 months now and report sales taxes to the state, but have not yet had to file a Federal tax form yet. What information do I need to submit to verify my income?

Thanks

Chris

I was self employed in 1994 when I did this before and I submitted my 3 years tax returns. I got an RFE requesting a letter from my Banks, stating the total amount of deposits in the previous 12 months. This time around, I just sent in those letters with my I-134. I am a K-1 visa though, not a I-864 yet.

The self-employed person states their current income from line 22 of, now, the 2009 tax return. If you've only been in business three months, that complicates things. Perhaps you could add financial statement from a CPA and a bank letter to go with the three years of tax returns. Use the I-134 for the K1 visa though.

Different consulates will llok at this differently, particularly if you are one that has written off most of your income to save taxes. Pushbrl wisely reccomends a P&: statement from an accountant.

You can also take your last 12 months de[osits to your PERSONAL bank and use that as your "current income" attach a bank letter or 12 months bank statements showing deposits. For most consulates you are not trying to convict someone of homicide, you are provisig plausible evidence that you can support your fiancee.

Sometimes self employed people take large deductions for things such as "depreciation" which is really just a "book charge". You have that income and deposit it to your account. This results in a low or even -0- income from the business, or even a loss. Income does not have to be taxable or even listed on a 1040 to "count". Child support, workman's compensation and military combat pay are not even listed on a 1040 but they DO count as income.

Attach at least one year tax return, three years if it looks better for you, state your current income as the amount deposited to your personal bank account in the last 12 months and attach statements to support it. If that does not qualify you or you are not comfortable with it, line up a co-sponsor
