Hi,

My wife’s niece, who lives in Ukraine is very ill with a brain tumor and may not survive. She is unmarried with one four year old daughter. What I would like to know is what would be the procedure for us to bring my wife’s grand niece to the US to live with us should her mother not survive?

Sorry to hear about your wife's niece. Adoption may work, but hopefully someone with more experience can give you a more in depth answer.

Sent AOS package (I-485 & I-765)on Sept, 2nd.

Package received at Chicago Lockbox on Sept, 4th

Checks cashed Sept, 14th

Received NOA1 for (I-485 & I-765) Sept, 17th

Received Biometrics letter on Sept, 20th (appointment for Oct, 1st)

RFE Notice sent Sept, 24th

Received RFE letter for I-693 on Sept,27th

Sent RFE request on Sept, 27th

RFE received at Lee's Summit lockbox on Sept, 29th

Am sorry to hear that. :( You may want to look into Ukrainian adoption laws and see how long the process would take and how successful they are (am thinking it may be easier since your wife is her relative, but you may still want to check).

Perhaps Gary and Alla may know something about this or can point you guys in the right direction. Is your wife a U.S. citizen already or a green card holder? That may also have an impact on how long it would take to bring her over.

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

It is not that easy, for obvious reasons.

Adoption by itself does not give any immigration rights.

I seem to remember one of the requirements is to have looked after the child for 2 years.

If this is imminent I would be looking for more local solutions.

I adopted 2 children from Russia 15 years ago. From the standpoint of USCIS it's a fairly easy and straightforward process. USCIS will defer to your State law regarding the processes needed. In my case I lived in California at the time and had to get a full blown home study done. Call your State and find out what you need in order to be able to adopt. Then USCIS will defer to the laws of Ukraine regarding adoption so find out what those are also. After that it's the same old - same old with USCIS ... file and wait.
