Removing conditions on wife's green card

Hi All,

My wife's green card expires at of Feb 2011 and she is currently outside of the US expected to return by first week of Jan. She will be gone for slightly over 3 months during this stretch. We will file for I 751 when she returns. The question I have is are we too late in our filing (approximately 45 days before expiration)? Also, how long is the processing period? Can she stay in the country, if her green card is not approved before expiry?

Read the guide: http://www.visajourney.com/content/751guide (must be filed within the 90 days just preceding the expiration date on your permanent residence card = green card). You should be fine filing 45 days before.

She will be notified by the processing center when they receive her post. Obviously, she doesn't need to leave the country when the new GC is in process.

The processing time depends on his residence. There are 4 processing centers and some works faster than others. You can check timelines on this website for people who have gone through the process in the same processing center.

hello, you are not to late to file but get moving on it, when you send in your 1-751 about 7 days you will get a receipt letter noa1 it will say one years extension,then the next letter is for your asc appointment center biometrics,after your biometrics you wait about two months to get a answer approval, or denial, good luck
