Hi All,

I am sure somebody has encountered this before, so all I need is a bit of guidance.

1) Primary sponsor is retired and derives income ONLY from SSN benefits. On I864, we provided 1099's for preceding 3 years (2009,2008,2007). Enclosed a letter that filer (sponsor) is retired and sole income from SS does not qualify to taxes.

2) Joint sponsor provided 1040 copies of tax return from 2009, 2008, 2007, 2006.

3) We received letter stating (Checklist for I-864 file by Primary_sponsor_name):

Supporting Documents missing or incomplete:

[x]The listed income tax documents/IRS statements for the years marked below are missing/incomplete ...

* Schedules are missing for year(s) [x] 2009 []2008 []2007 []2006

* Federal income tax returns, literal printouts from IRS(RTFTP) or a letter 1722 issues fy IRS are missing or incomplete for the year(s): [x] 2009 []2008 []2007 []2006

* W-2 forms are missing/incomplete.. [x] 2009 []2008 []2007 []2006

[x]You have not enclosed explanation why you were not required to file income taxes ....

Question: Is this requirement for the joint sponsor or for the primary?

If this is for the primary sponsor who has not file taxes, what do I need to send back? 1099 for 2009 and explanation letter?

If this is for the joint sponsor, I can get the IRS tax statements for 2009?

I want to suggest that you post this in the IR-1 / CR-1 forums, which have a lot more active members than the DCF forum so you might get quicker feedback there. Good luck!
