More questions: dual nationality & TN status

I'm sorry for not including these questions in my first posting (and for not posting in the correct forum! :) )

My husband (TN visa - Mexico) was born in England and has an EU passport, but his TN visa is posted (obviously) in his Mexican passport.

When we submit his birth certificate for the AOS, will it be necessary to submit both the British and Mexican, as his Mexican copy states he was born in England? Or will the Mexican suffice, since his visa is issued under the Mexican passport (which states he was born in England)?

Also, I've read postings of couples who were worried about marriage after the issuance of a TN visa...His visa was initially given in '08 for a year, renewed in '09 for three, and we weren't married until 09/10. That's fine, right? He still has two years left of TN status, but we'd like to begin the application for AOS & GC.
