Oh my, :crying: in the most wonderful time of the year this just happend to you - makes me so sad :(

My prayers will be with you.

For now.. all what I can say, is for u to enjoy the time with your family! Believe in Got, pray, fasting.. everything happend with a reason! Be strong and patience now in this proces - find an activity... to make the time go faster...cause' it will take some time :(

HI! Thanks, i will need all prayers i can get right now. Yes, i found out that i maybe have to wait 10 years to get back in, but he is going to apply today and we are talking every day on msn,phone and that, and hes telling me that he will be here and visit me for a month, and then go back,and try to talk to lawyers. but the worst part of this , is that we really wanted a kid together and im 32 now. I will be 42 years old when i can live there with him. i never stopped crying since i talked to the people in here and they told me i am banned for 10 years or maybe life time. but we love each other and we would wait for 10 years, god will make a way....

It does not have to be Sweden, could be anywhere outside the US.

But I would not give up on the waiver, just needs time and perseverance.

It's really sad to hear about a situation as heartbreaking as this, I hope that in time you will be able to get through this and be happy.

I just wanted to agree that a lot of Americans and foreigners are really ignorant about the immigration process and the strict rules and regulations that follow it.

I myself can attest to my own ignorance just before me and hubby had gotten married we didn't know anything about immigration, thankfully he had ties that caused him to go back home after our wedding and we weren't in a hurry at the time since we didn't know which country to live in at first or I could be having a more difficult time than I am now.

I think everything in life happens for a reason though so I wish you the best of luck.

You've had a lot of good advice about what you might be able to do to eventually get back to the US.

I can understand being married to someone who is more tied emotionally to the US than you are to your home country: the same is true for my husband and myself. There is always the option for him to travel back home to visit regularly - especially as he'll have a lot more paid vacation time living in Europe than he'll have visiting you!

You can obviously speak very good English, whereas I imagine his Swedish is a little rusty ;) Look into what options you might have to live in one of the English speaking European countries, since this will make life easier for him to transition and find work quickly. Before he leaves the US, look into what he needs to do to move to Sweden with you permanently. Research the Swedish immigration laws. Everything that he needs to do from a US immigration perspective, like filing the I-130 as suggested (which you need to do before you can even consider trying for a waiver) he can do from Sweden, as long as he's got an address (like family) he can use on his application. He doesn't need to go back after a month, unless his visa to Sweden forces it.

Only you two can choose how to move forward in your life together. Don't rush into costly processes without researching your options more fully. You've already been badly stung by this once; work on making the best that you can of this situation and accept that unless you can deal with at least several years apart, he/ you both are going to have to move somewhere other than the US.

I doubt it, but since am not really familiar with the immigration laws applied for those EU countries, so I just can't be sure.

They will definitely have to deal with that country's existing immigration law. Even if you are a US citizen, you will be allowed in, but you can't just go to another country and work without an authorization.

When you already have serios issues related to immigration in US, do you really want to deal with another country's immigration laws on top of that?

I am sorry for your situation.

I have a friend who overstayed her 3 months visa in the states for just 1 day and she got barred for 2 years. I could not imagine how this is for you.

I hope that this can get fixed.

Sweden is a cool, rocking place to live.

and with the right SPOUSAL visa (whatever SE calls it these days)

the husband can work in Sweden - which would be mondo cool.

If I were in his shoes - (and this is just me)

I'd have a fire sale, rent out the house , and move to Sweden,

with just 2 suitcases and 2 computers, get my papers in Sweden,

and either work as an employee or set up a small business.

Lots of 'power' when a spousal visa is involved, I'd move heaven and earth to get one in her home country.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Since Sweden is a member of the European Union she can move and work within the EU and, under certain circumstances, even get unemployment funds from Sweden for a few months while she is looking. http://ec.europa.eu/...n.htm?profile=0 Not sure how easy it would be for her husband to migrate but it might be easier for him to get a job in England or Ireland than Sweden.
