Got married and left Usa, Help!!!

When you left in 2010, you triggered a 10-year bar from returning. This can be overcome with an I-601 waiver, but that waiver is pretty much impossible to get for somebody in you situation.

You'll have to wait until 2020. The only way for you and your husband to live together is if he moves to Sweden.

Sad to say, but that's kinda what I was thinking also. :(:crying:

What kind of right basis? He cant come here and just visit?

Make sure he knows what the visa requirements or VWP requirements are and that he doesn't overstay when he's there. It'd really stink if you both were banned from each others country.

I think that over the years, Hollywood has given the impression that if you marry an American, you're automatically entitled to come to/stay in this country. I have talk to many people that think this is true and asked me why I didn't just marry my fiancée in the Philippines and bring her here on a plane when I returned from visiting her.

A lot of people believe this. Prior to finding a forum about the city where my wife lived, I had no idea what was involved. I knew it wasn't so easy as her just coming here but I never imagined how difficult and arbitrary it is. Even now, many people I talk to here ask why she is not with me yet. When I explain the process they are shocked. It is entirely understandable that someone who has never looked at the process would think if they were here and got married that was all they would need. Long before three years however, things like a social security card should have come up and the issue would have been brought to light then. Not sure how they managed to get a SSN for her or if not, how they filed the taxes. Fortunately that is a separate issue from the immigration question. Best advice is be prepared for a long hard journey now. Filing the I-130 is important, but have your husband read the guides here first. There is a mountain of evidence that will need to go with this. Best to have all your ducks in a row. You don't need to talk to an attorney before filing this, but definately get yourself a very good attorney. The best you can afford.

Also, don't beat yourself up too much about leaving and triggering this whole mess. My understanding is even if you had stayed and started the paperwork here, such a long overstay would have caused problems anyway.

Gosh, Sweeden isn't such a bad place to live either. I would also check into the immigration laws there for your husband. I was prepared to move to the Philippines to be with my wife if I had to, and we may end up living there anyway.

He might be able to stay over there for an extended time while awaiting for the denial and waiver application here.

Don't be hard on yourself. It's OK to cry too. You have to let something like this out. My God what a horrible thing. So sorry for you.

I am so sorry to hear this BUT the positive thing is that you LOVE one another and have each other even though it is miles apart and these trying times only makes the love stronger! No kidding. The people who are outraged about me not being able to work yet are usually the ones who are extremely prejudiced about immigration. Kind of ironic. They know me, so they show goodwill towards me, but they hold radical views when it comes to immigration in general. Sheesh.

How did you work for 3 years? What did you do when they asked you for an ID or driver's licence? Did you really think that it is enough to just get married and you become legal automatically?

well, you dont have to believe, we know and god knows. i didnt work there, he did. and i never drove a car, and i just lived my ife with him, i never thought about these things, and maybe u dont believe me or someone else, but i know what is the truth and god knows i dont lie, but thanks for your opinion. If i knew all this then when i was there with him, ooooh i would apply , i would do anything, but now im here, without him, and it hurts, and i cant eat,sleep, i want to hear his voice all day n night,im blaming my self for this,but hes telling me that we didnt know,but if i only just looked into it for just 5 min, when i was there for 3 years, i would know and i wouldnt be here and cry and write in here like a stupid foreign. :(

Rose, some people (unfortunately) will be very harsh to you, and I hope this doesn't add to your stress!

You are in this situation because you did not know.

And I'm darn well sure that if you only knew what could happen, you would have never left and apply for your AOS instead!

Some of us know these things because we had to sweat blood to get a visa to come here.

Others like you probably got here without even having an interview.

And from your own comments, you had a wonderful life here, so you never had to look up immigrations stuff even to get a simple SSN to apply for a driver licence or a job.

So STOP BLAMING YOURSELF!

Be strong and most importantly DON'T GIVE UP!

There are many good advices from people here that you can use to help you in your long journey!
