Hi everyone,

This may be a silly question but when we are filling out I-485, I-765 and I-131 after getting married in New York do you fill in all the forms with your new married last name? I believe that all that I need to officially start changin gmy last name in the state of NY is let the city clerks office know and hten they type the marriage certificate as such and then you use that to get SSN and then driver's and so on....

I'm hoping to get everything in order so we can just pop it all in the mail shortly after the wedding on Jan 8th!

After you get married on the 8th and then you do your AOS you will have your marriage certificate and if you are taking your husbands name , then yes you fill in everything in your married name. You don't have to let city clerks no as far as I am aware. When you go to get your license you put your maiden name on there and then your married name is on the bottom of certificate after marriage celebrant hands it in .

Depends on your state. In iowa it's not like that. In iowa you have "name before" and "name after" marriage. I also sign in my "new name".

OP make sure you mention it when you get your licence so you do what your state requires. In terms of AOS yep, just write your new name on all the forms. In the US you need to change your SSN before you can change your drivers licence, but you should be fine to change your bank accounts (that's what I did first so I could practice signing my new name). When you go to the SSA to change your name you MIGHT have problems if your I-94 is expired as they don't know their own rules very well (you're supposed to be able to change it even after the i-94 is expired, but sometimes you have issues). It's not the end of the world because once you get your EAD you will have no problems.

Thanks but I should be ok with my I94 as my POE will be Dec 30th and then the wedding is on the 8th! So Im only going to go to the SSA office after I have the wedding certificate in hand....

Ooo just be careful there. Some people have had issues trying to get their FIRST ssn in their married name because USCIS still has them as maiden name. Some offices will try and tell you that you're not a K1 anymore because you're married (one office tried to tell the girl she was K3 'cause she was married now.. complete bull)... depends on your SSA office. Some offices are really bad, some are completely fine.

If I were you I would let them know you're okay getting your SSN in your maiden name if they have problems with your married name (you can always change it later) and make sure they realise that you still ENTERED on a K1 visa so you're still a K1. Just like someone who enters on a B2 visa and gets married is still a B2 visa entrant. Marriage changes nothing but your last name and marital status. It does NOT change your visa type (and therefore doesn't change your SSN eligibility).

That's what we did. Be sure to print the SSN guide info from VJ and bring it with you. K1's aren't all that common in the grand scheme of things so the person at the SS office might not be aware of the process.
