Hello,

I need some help to figure out what should I do.

I have a sister that lives in Belgium and she is a citizen. She has a baby girl and she will be divorced in May 2011. I am trying to start the process to get her here so we can have each other closer. I know that is more complicated because she will probably have to get her ex-husband's permision to leave Belgium with her daughter.

My main concern is that if I introduce her to somebody here and lets say they will want to get married will that affect in any way the process that I already started to get her here?

I will appreciate any advice.

hi, your sister is a citizen,belgium i don't think your sister can come any time soon, maybe five to ten years, you need to rread the guides, on thi page to bring sisters and brothers to the us, vjwiki guides, sorry i can't give you better news, good luck

They are currently processing petitions from Sept 2006 for brothers and sisters of US citizens. You will want to do some research on it and see if you both are really prepared to have that kind of a wait time or longer.

They are currently processing petitions from Sept 2006 for brothers and sisters of US citizens. You will want to do some research on it and see if you both are really prepared to have that kind of a wait time or longer.

probably you are checking the wrong bulletin. the wait is over 8 years. the visa bulletin for siblings is for January, January 1st 2002.

maybe you were refering to the service center bulletin, not the visa bulletin

the time of approval of the 130 depends on the service center, but after that, it's a very long wait for siblings. There is only one category for siblings, so there is no change if she is unmarried or married. there is no difference.

Thank you all.

We are ready to wait but reading the guidlines I got confused..... Do I need to file separate for my niece? She is my niece not sibling so isn't that more complicated? I cannot figure this out..... help!

she is a derivative of your sister, meaning as long as she is under 21 and unmarried she will come with her mother, and under her mother's petition.

on the i130 there is a section to add her. Depending on her age she might need in the future her father's permission and your sister will have to have full custody. if she is still married you will have to write down her husband's name as well, until she is divorced.

this doesn't mean he will be coming, but as of now, she is married.

If it is a bay girl then we are probably looking at an early teenager when she could come over with her mother, not of marriageable age.

She would need the fathers permission.

To start the process for your sister you need to be a citizen. LPR's can't bring siblings and even Citizens can't file directly for niece's. Once you file the wait time is 8-10 years at best for a visa number to be available.

This will not be over quickly. You will not enjoy this.

Missed that she was not a citizen.

So it would be mid/late teens.
