affidavit of support questions

Hello all,

I am a little bit stuck here due to some questions in regard to the form I 864:

1- Is it obligatory for my fiancée to complete the I 864 as she is a full time student? Can just her Dad sponsor me?

2-My fiancée has filed tax returns for only the 2 last years, not 3, so what should be her answer for that question? She told me that she didn't qualify for tax return this is why she didn't file it... So should she check the box on the form still or just leave it blank?

The newest I-864 forms require only 1 year tax return. If her income is less then 125% poverty line then have parent co-sponsor the parent would use I-864A.

She still will be the primary sponsor.

Use the newest I-864 forms avalible at the USCIS website.
