Hello,

My wife and I just got married. She is currently here on a tourist visa. We are about to start the application process for her change of status.

A couple of questions:

1) When applying for change of status, should she use my last name, or her maiden name, which is on her passport and other documents?

2) I am a little unclear to when she should take the medical exam. It states it is valid for 12 months, thus should we just do it now to get it over with, or are there other considerations we haven't taken into account?

Any thoughts would be much appreciated,

Christopher

If she is to take your last name as hers, fill out all AOS with your last name.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

When applying for AOS, she should put her married name [or whatever name she wants to appear on her GC] as her main name, and put her maiden name in the "Other names used" field.

I would do the medical now, to get it out of the way. It will have to be included with your application packet anyways, so it needs to be done before you send anything in anyways[i think.]. I can't think of any other consideratiosn that would make you want to put it off.

Just to clarify:

If she wants to change her name then use her new name.

If she wants to keep her maiden name, then use that.

USCIS is smart enough to figure out that her passport was issued before she got married. And yes, you do the medical now and send it with the whole application.

Good luck.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
