Hello all! I had one more quick question. I've read over the guides.

I wanted to triple check with the recent filers what the (new) fees are for AOS before sending off my AOS stuff.

I-485: $985 + $85 (biometrics) = $1070

I-765: No additional fees if file with I-485

G-1145: No additional fees

I-131: $360, regardless of whether I file with the I-485 or at a later date. Can someone please please confirm this? :)

I-864: Nothing now, $88 fee (currently) later when my spouse/me hears from the NVC to pay (this took a bit of research to find!)

um no? 131 is FREE with aos and you dont pay for 864.

the fee is $1070 for AOS.

For AOSing from a K-1 visa, you include the I-485, I-765, I-131, and any supporting forms and documentation referred to in their instructions, and a single check for $1070 covers everything.

Only additional fees would be if you were also including the AOS for any children of the beneficiary. But if it's just one person, $1070 covers everything.

That I-864 $88 fee is not applicable to you... that is for people with other types of visas. You will not be dealing with NVC anymore. Inky is right, the amount for all of those forms filed together is $1070.

I just re-read the "Filing Fees" portion of I-131 again. I missed the last "or" in the first sentence. Oops!

NOTE: If you filed Form I-485 on or after July 30, 2007, and you paid the I-485 application fee required, then no fee is required to file a request for Advance Parole OR for a Refugee Travel Document on Form I-131. You may file Form I-131 for advance parole or for a Refugee Travel Document together with your Form I-485, or you may submit Form I-131 for Advance Parole or a Refugee Travel Document at a later date. If you file Form I-131 for Advance Parole or a Refugee Travel Document separately, you must also submit a copy of your Form I-797, Notice of Action, receipt as evidence that you filed and paid the fee for Form I-485 required on or after

July 30, 2007.

Apparently there is a fee to "review" the I-864 if filed in the US (which is the case for me!). I had to go looking, but it looks like the NVC sends you/spouse a notice asking for $88 once it gets to that stage.

Oh okay, thanks everyone! Nope it's just me filing (no kids), so it is $1070.

I thought I had everything, but turns out I need two more photos for the I-765. I knew I should have gotten an extra set when I was at Costco getting the photos for the I-485!

Ya you need 6 photos total for AOS if you are filing for EAD and AP documents.

You're absolutely right, Inky. I wasn't going to file the I-131 (I am tired of airports, flights, and crossing the border for awhile), but now figure I might as well since it's free.

Can I ask quickly what needs to be attached as supporting documents for the I-131?

I plan to attach the following:

1. Copy of Canadian Passport Biographic ID Page

2. Copy of K1 Visa from Passport

3. 2 Passport photos (identical)

4. NO USCIS receipt as evidence filed for AOS (as filing concurrently with I-485)

5. Explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole Document

As for #5, my only reason I'd go up is if one of my close family members/friends had an unexpected serious medical or other emergency...I don't really have "evidence" of that.

For reasons for travel I just said "Possible future medical emergencies involving my elderly grandmother", "Miscellaneous visits to family and friends" and "Brother's possible future wedding in <4 months from then>".

That was fine. They just want a reasonably plausible possible reason. It's not like they check or follow up. The vast majority of issued AP documents never even get used.

I filed in late September 2009, and I put date of trip as January 2010, as thats when my brother's wedding was intended to be. Ended up that I had my GC by then, so it didn't even matter.

Expected length of trip was 2 weeks.

Again, as long as you have reasonably plausible, reasonable stuff in there, they don't care too much.

There is nowhere for an AOS applicant to write "reason for travel". An AOS applicant does NOT need to provide ANY explanation for the reason for applying for AP, as an AOS applicant that is their reason. It's right there in the instructions that an AOS applicant doesn't include anything.

OP once again. There is an AOS thread in my signature that has the list of required documentation, you will find this letter explaining a reason is not there because it's NOT required/needed.

For date of trip and length of trip I wrote "unknown" for both.

As stated, #5 doesn't exist for an AOS applicant. It's there in the instructions that as an AOS applicant that this letter is not required. I did not attach an explanation or other evidence and I applied for AP concurrently with AOS. EAD also required NOA1 but as you're filing concurrently you don't attach that. I was never issued with an RFE for not including it and neither has anyone who followed the AOS thread in my signature, because as a concurrent filer it isn't required, just as the fee for the EAD and AP docs aren't required yet you include no "proof" of concurrent filing to avoid the fee.

I started a thread about that a while ago. Thanks for reminding me. The existence of that letter here on VJ makes people think they need to include it. You don't.
