Roxie have your husband come here and read the guides (at the top) for the CR-1 visa. The sooner he starts the process the sooner you can apply for a visa.

Also have him read about the I-601 waiver which will be needed if you remain more than 180 days past the date on your I-94.

Also have him read about the I-212 waiver which you will need if immigration finds you and begins deportation proceedings. You are out of status and are deportable. Since your ex-fiance was abusive it is very likely he has already notified ICE of your overstay.

Rexie you are really trying to find other answers in the advice you are given.

The only way for you to be in the US legally with your husband is if you return to your country (Mongolia as your profile indicates) and have your US Citizen husband file a spouse visa petition for you. This will be a CR1 petition, not K3. Anyone telling you to pursue a K3 is not giving you current advice.

Keep asking the same question and you will continue to get the same answer.
