I am really getting confused and hope someone can help. First off my fiance is here on a tourist visa. its multiple entry so right now he is back in his home country. How long does he have to stay gone? Can he re-enter in a few weeks with no problem? And if when we deicide to marry and file the CR1 will he have to stay in his home country til the visa is approved or can he come back and forth? Also is it possible to just adjust off the tourist visa? Which is easier?

Well which one is it - is he a visa overstayer as you said in another thread he overstayed his visitors visa. Then you thought about AOS as he lined up a lawyer. Not you say he left the US and is wondering when he can return.

Questions for you (him): when was the last time the entered the US (month, year) and how much time was he given on his I-94 and how many days/months did he overstay before leaving?

He can visit on his tourist visa while the CR1 is being processed but it is possible he will be denied entry. It is always up to whoever he gets when he enters at POE as to whether he will be let in, visa or not. You cannot adjust from a tourist visa if he had the intention of marrying you when he arrived on it.

If he is denied entry, his tourist visa will be revoked and he will not be able to travel on it.

He needs to spend more time in his home country than in the US. This is what the CBP looks for, along with strong ties to one's home country
