So it means even if you have appointment letter already that does not guarantee that you have a Visa Number?

Yes! As per lawyer indication. No one knows what stage NVC or DOS assigned visa number. It is also make sense that visa number is depend on per country availibity.. I believe some countries F2A filer will not apply any retrogression as per according to visa bulletin :thumbs:

F2A Story:

I have a friend, who applied I-130 application on Feb, 2010, he expedited the process which was valid reason & USCIS approved I-130 in June 2010. If you look at the June 2010 visa bulletin...he is not eligible for NVC process, but NVC did process & he got visa approval.

What i found about him, his country has visa number available at that time. I belive USCIS & NVC internally know what country has visa number available. This is how they process the case. This is mine believe. please correct me if i am wrong.:(

F2A Story:

I have a friend, who applied I-130 application on Feb, 2010, he expedited the process which was valid reason & USCIS approved I-130 in June 2010. If you look at the June 2010 visa bulletin...he is not eligible for NVC process, but NVC did process & he got visa approval.

If your visa number is not assigned, at the interview time you might ask for hold decision until visa number available.

So guys we have to find whether visa number has been attached to our case file.

I have called NVC, USCIS headquarter and also DOS. No one can tell me about that, even lawyer dont know what stage visa has assigned to case file.

but i know employment visa stage which is very easy question :devil:

A VISA ALLOTMENT or number is assigned between the case compelete and interview stage. if a visa # is assigned an interview will be scheduled as the immigrant now has a visa to enter the USA

Agree The I-130's approval ONLY establish a relationship... nothing else.

Well I know NVC processes cases that are current or will work on those that will become cuurret. After the case is completed at the NVC stage a visa slot is submitted to the DOS (# of applicants) and from I understand the NVC will notify the consulate and then only they will be able to schedule an interview as visa numbers maybe not available.

January 15, 2011 is just around the corner.. let us see what it brings us.

Well I know NVC processes cases that are current or will work on those that will become cuurret. Would you please explain this NVC note what i found out at DOS website:

If a visa is available for your petition (or if the Department of State believes that one will be available in the next several months), the NVC will send you, the beneficiary, a Choice of Agent and Address letter containing the form DS-3032 and instructions for completing the form. If you are the beneficiary of an I-130 petition, the NVC will send your petitioner an Affidavit of Support (AOS) Processing Fee Bill Invoice along with instructions for paying the AOS fee.

If visas are not available for your visa category, the NVC will notify you that the NVC received your petition and will hold it until a visa becomes available.

My understanding NVC doesn't process your case until visa available or will be available in a month or 2 . So, people who already got approved I-130 before December, 2010 & priority date is current. I believe their visa number already assigned to the case

But still confused when they use the visa number at NVC process.:(

Hey Miami Boy,

We are on the same boat, My spouse NVC completed on Nov 23, 2010 & Waiting for interview date.

I just want to add something here .......

How long it will take the file to forward to Consular abroad.

First: I called embassy two days back and they said they have no information on my case, means they haven't received the file and no clue of interview date

Second: I called NVC two days back and they replied that they are in process of scheduling the interview dates and said that call us next week around on 14-15 Dec for updated information. Now, Nov 09 Visa Bulletin RETROGRESSION.

A VERY BIG "NOW WHAT" ???? FOR US

I haven't finish with NVC yet, Freaking RFE never leave me alone. My case also depend on your interview schedule. If you get through with schedule interview, I beilieve my case also forward to the embassy for visa processing. Insh Allah we both make it this time after waiting so long..............:star:

"What this means is that if your priority date was “current” in November 2010, but will retrogress in December 2010, you would not be eligible for a visa or for adjustment of status until your priority date again becomes current. Below are the priority dates for December 2010"

Well, This will apply for only Adjustment of status in the USA, He didn't mention what will happen for those F2A already processed or completed at NVC for USEM overseas interview?? We probably can see some action from Monday at NVC. :bonk:

I would like to know what will happen if your case is not complete yet but a visa was already assigned to the case, will they take the visa away?

I30 sent 01/2010 (can't remember the exact date)

NOA1 January 29,2010

NOA2 February 26,2010 ( yes it was that fast, still Thanking God for that)

Transferred to NVC

March 5,2010, i received my case # and no visa was available

June 4,2010 received AOS bill via email and Paid the same night

June 4,2010 received Visa Application Processing bill Via email and paid the same night

July 15,2010 mailed the AOS form and documents

August 27,2010 mailed DS-230 form and documents

September 30th I thought my case complete but received an RFE later on, still in the process
