Question on when fiance can work?

Hi Guys,

When Marcel and I arrived at JFK, the one thing they did was give him a small, stamped piece of paper and the guy said it was his WORK AUTHORIZATION STAMP so Marcel could work. He also copied down Marcel's green card number which he seemed surprised he had a number already.

I tried researching on here about it and I am confused whether this allows him to work or not? Thanks for your help on this...... :help: :help:

hm, i was under the impression they didn't give those anymore, but from what i heard of it, it was just a 90 day permit. if you got your AOS in like tomorrow, and file the advanced parole and work allowance thing with it then maybe it would come back before the 90 days in which the first one expired? but otherwise he wouldn't be allowed to work as soon as the first one expired and until the 2nd one kicked in. and i believe that even with the 90 day one, he still needs a social security number?

not positive on any of this, just stuff i remember from searching old threads and asking questions.

lol My head hurts from this.....He was offered a small job yesterday just to get something to keep him busy btu I didn't know if he could apply for it with just the stamped authorization paper....

what Kristy said its true... well I have heard the same thing... and I also thought they were not giving those work stamps anymore.. what I have heard is that he can work but until you guys get married!.. once u guys get married he has to apply for a work permit!... so he would need to stop working once the stamp permit is not valid anymore!.. well thats what I have heard.. anyone can correct me if im wrong!!

The stamp is not supposed to be accepted for e verify. Even if he gets a job he would have to give it up when the I 94 expires. He doesn't have a green card the number should match his A number minus the A. Once you get married and file he should be able to work within a few months. It is always best to take the safe route with when you deal with immigration.

This will not be over quickly. You will not enjoy this.

What do you mean by e verify? I don't know any of the forms you are talking about so this is confusing to me. Also are you saying the safe route would be to wait until we get married and apply for his AOS etc..?

He can't work until he gets the EAD card. The stamp in the passport doesn't allow a K1 to work. Sorry. Working is illegal unless he has the EAD or GC.

There are many many posts about this. Including a full explanation about how JFK is not supposed to give out the stamp anymore because it confuses people.

if you wanna keep him busy, make him a list of honey-do's. fix stuff, organize/re-organize, yard word, housework, etc?

get his social security card and then as soon as you get married file for his AOS and file the work permit form (EAD) and the advanced parole form with it, then within 3 months-ish he should get those approved and be able to work and leave the country with the ability to return to it (if he needs to for any reason). and i think around 4 months-ish he should have his first green card (good for 2 years).

I would go the safe route and wait until u file for AOS. We successfully got our ssn yesterday they said it will arrive in 7-10 business days so be patient......my fiance keeps busy by looking at the naija station we have on satellite he also reads a lot.........good luck

K-1 is not authorized to work unless they have done AOS and gotten an EAD or green card. K-1s do not get greencards untill they do AOS.

Not only the "safe" route, but the LEGAL route. The disadvantage of the fiance(e) visa is that the beneficiary cannot work immediately. After you legally marry, prepare the Adjustment of Status papers (AOS, Advance Parole, and Employment Authorization Document) and submit. The EAD will take about 3 months to get approved. In the meantime, your spouse can be the best househusband ever! Also, he could enroll in school, volunteer, etc. He can actually do any activity in which he is not working, i.e. receiving money for favors or services, as doing that would be illegal.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
