Salem alaikom, daba besmiallah !

a khouti fi alleh ,ma situation est vraiment grave après une année de mariage avec une femme américaine !

3atkouni ila rani mkhati wila rani msetti !

* tout a commencer par un mariage de Fiancé VISA K-1 !

* arrivée a Kentucky ya presque un an ( janvier 2010 )

* j'avais 6000$ en poche dans ma rentrer le premier jour ( après 02 mois mes 6000$ est disparus en consommation) a cause d'elle ma dit tout est facile je te rembourserais après !!!!

* je me sens seul malgré ma bonne foi en vers d'elle depuis le premier jour !

* des coup de téléphone avec des amis et des soiré sans moi et en plus la trahison avec un copain !!!

* j'ai travailler une seul foi dans cette année et maintenant je suis en chaumage !!

* elle ne me respecte plus comme avant ( elle me dit :si tu veux ke tu rentre au Maroc ,c pas un problème pour moi )

* carte verte conditionnelle reçu ya presque 3 mois !!

EST CE QUE J'AI LE DROIT DE DEMANDER UN DIVORCE SANS RIEN PERDRE ( ma carte de résidence conditionnelle et mon permis de travaille )

et SI OUI! COMMENT FAIRE LES PROCHAINS ÉTAPES ET AUSSI COMMENT FAIRE POUR RETIRER LES CONDITIONS DE MA RÉSIDENCE ?

December 27, 2009 - Wishing each other a blessed 2010. -When we met
February 25- I realize I love this amazing man! (but of course I must see it and feel it in person to know for sure )
June 22, 2010 - The day I first lay eyes on the man that I love.
December 29th 2010- January 6th 2011 - second trip to Morocco, an amazing time with an amazing man. He tells me I am everything he needs and more and hopes that he is the same for me... of course!! I accept his proposal and we are engaged!
October 2011 - So very much in love still, can't wait to see him in December
December 22nd,2011- January 9th 2012 - What a wonderful time, we had an engagement ceremony, and finally we decided it was time to start filling out some papers! Hoping to send it off in late March !

May 8th, 2014 Hicham is given a 221g at the Consulate and told that the petition has been sent back to USCIS. :( HEARTBROKEN. Yet, determined to convince them.

September 29th, 2015 MARRIED.

June 2015- Still madly in love, and madly missing each other.

September 29th, 2015 Mailed CR-1 Petition.

October 1st 2015 NOA-1

December 2nd 2015, Notice of Action- Transferred to Local office in Arlington, VA

The Journey continues....... missing each other like crazy!

If I may, I'll give a brief of what you're saying so that non-French speakers may also help. And please keep your next posts in English if possible.

So in a nutshell: the OP moved to the US from Morocco on a K-1 visa. During his time in the US his wife wasted his savings, cheated on him with a friend, he's been feeling lonely and is now unemployed. His wife doesn't care for him anymore, she's telling him he can return to Morocco.

He is asking whether he can file for divorce and whether this will compromise his ability to remove conditions later on (he received his conditional green card 3 months ago).

Now, to answer your questions: yes, either you or your wife can file for divorce. That means, when the time comes to file I-751 to remove conditions you will need to file as "divorced" and attach your final divorce decree. Things are going to be more complicated for you, as you need to prove that you entered this marriage in good faith and you need documentary evidence for that. If you have documentary proof about your wife cheating on you or wasting your money like you said, that will help your case. In addition to that, you will need to submit your application with a ton of evidence proving the bona fides of your relationship and marriage, or you run the risk of being suspected of immigration fraud (i.e that you married your wife just for the green card).

If you can afford it, it's worth hiring an experienced attorney to help you with that, as you need to get it right in order to maintain your right to live and work in the US.

* aArived in Kuntucky almost a year ago (January 2010)

* I had $ 6000 in my back pocket in the first day (after 02 months my $ 6,000 is missing in consumption) because of she,and she told me everything is easy I'll pay you later!!

* I feel lonely despite my good faith towards her since the first day !

* Phone calls with friends and night without me and most of treason with a another boyfriend !

* i worked one time this year and now without work !

* she does not respect me as before (she said : if you want to return to Morocco, it isn't a problem for me)

IF I HAVE THE RIGHT TO SEEK DIVORCE WITHOUT NOTHING TO LOSE (my conditional resident card and my driver's work)

and IF YES ! HOW TO DO THE NEXT STEPS AND ALSO HOW TO REMOVE THE CONDITIONS OF MY GREEN CARD RESIDENCE ?

One has the right to seek divorce if the marriage is broken beyond repair. That 'right' is independent of your immigration status because the dissolution of the marriage doesn't happen with USCIS or Dept. of State. Given that you are a conditional resident, a divorce would mean that you would have to apply for permanent residency as now divorced but having entered into your marriage in good faith.(When you look at the Removal of Conditions application, you'll see that it is a different check box that you mark depending on your status at the time of the application). Your evidentiary proof to support your application would have to consist of evidence to show that the marriage was 'real while it lasted' along with the documentation of the divorce. USCIS will adjudicate your application based on its merits.

so i live my life with this bad situation in her house and then i am as an stranger in this moment " since 6 month ago " so when i'll be ready to go out or to take my decision i know that she want to be free and peacefull in his life !!!
