I hope you can give me an advice i will appreciate it. I came in the US for a k1 visa and we live together with my fiance but after 1 week of staying with him things change he abused me he's fighting me yelling and screaming and i'm so scared to stay with him anymore so i to call my aunt that i need her help because i want to go but my fiance don't want me to go and he dont open the door so my aunt call the police and rescue me so i leave him and i live with my aunt and broke up with him. After 2 weeks i went online and i meet a guy on chat and after 2 weeks me meet and he feel pity of what had happen to me and we become gf and bf and he wants to marry me before my visa expired so we get marry after 10 days of the expiration of my visa. My problem is, Is this not against of the law in immigration that i didnt marry my petitioner and i marry with the other man? Do you think this will work in the immigration? What should we do? In order to understand why the responses have been offensive you have to take an unbiased look at what you've done, and the timeline in which you've done it.

You came to the US with the presumed intention of marrying the US citizen who sponsored you. Within a week you broke off that relationship claiming you were abused and went to stay with your aunt. Two weeks later you found a new boyfriend on the internet. Two weeks after that you and he are dating. A bit over 3 months after arriving in the US, you married your new boyfriend.

Any casual reader would see the above scenario as a bungled attempt to manipulate the immigration system. Sorry if that's offensive, but that's the truth.

You can't get a green card based on the claim of abuse because you weren't married to the abuser. You can't get a green card based on your new marriage because you entered with a K1 and didn't marry the petitioner. Unless you have a valid claim for asylum, you have no basis to get a green card and stay in the US. You are currently out of status. If you remain in the US for more than six months beyond the expiration of your I-94 then you'll be banned from the US for three years, and your new husband will need to file a hardship waiver in order to get you a visa so that you can return, presuming your new husband is a US citizen and not an LPR.

You either didn't do your research well enough, or you made a catastrophic series of mistakes in your personal decisions.

Sorry, you have to return to your home country.

Agreed.. Daddy always said "dance with the one what brung ya or go home".. you must return to PI and start the visa process over with a CR1.. if you wait too long you will start acruing overstay which will count against you...

Not trying to offend the OP but this smells fishy!

First, the new BF wants to marry her because he "feels pity of what had happened to her" so in essence he wants to marry her just so she can get an immigration benefit, that's fraud.

Also, in a real abuse situation wouldn't she still be recovering from the ordeal of moving to the US and being abused. I mean really after 2 weeks she's trolling the internet looking for another Kano?

Finally, what a coincidence that the first Kano lived so close to her kind Auntie who rescued her.

I mean it really sound slike somthing was going on from the get go here.

@OP, sorry with K-1 entry you can only adjust status based on marriage to the original K-1 petitioner. This is to protect him for situations like this. You must return the the Philippines and get the new BF to spend thousands of dollars to bring you back. FWIW, you visa was no longer valid once you used it to enter the US, now the I-94 validity is what allows you to stay for 90 days, if you overstay then you will complicate getting another visa of any kind.

Its difficult to know what is real here as the country of origin appears to have changed overnight.. much like the initial marriage intentions...

Well, to me it sounds fishy because if the police came, they could have done something like questioning the petitioner...

According to the OP, she just went to her aunt's house and live there, went online and found a new man like nothing ever happens. :-)

I think as everyone has been saying you will need to go back home. It appears that you probably were abused or not. However it seems your plans were not well thought out. This truly makes it hard for the legitimate folks who apply. It seems too fast you found someone to marry that quickly. From the outside it looks like you tried to use this bloke but you have messed yourself up. Go back home and have your current husband file and goodluck to a very long and arduous journey

Exactly. Whether through ignorance of the system, or willful disregard, or blatant fraud, these scenerios are what make it so much more difficult for the rest of us.

As you say, we don't know the entire situation but the bottom line is you are not following through on the guidelines of the K1 visa so you must now return to your home country and pursue a CR1 with your husband.

the OP reminds me of the ex-wife of a VJ member who posted a little bit ago about his wife coming here and after short time she started arguing with him a lot and the aunt took her into her home and this girl after a few weeks found another bf and wanted the VJ member to still sign the paperwork for her to be able to marry the new guy...also the new bf called the petitioner asking him to do this also...I swear this looks like the OP is that VJ member's ex-beneficiary.
