Hi, my husband (USC sponsor) is filling out the I-1864. He is sponsoring me (his Canadian wife) and my daughter (his stepdaughter since we married before she turned 18) and a question has him stumped: Part 5, question 21d states that "you may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax returns." He put me down as a dependent since I'm his spouse but he's not sure whether to include my daugher for two reasons: he did not claim her as a dependent on his income tax return last year (and won't this year), and she is about to reach the age of majority here in BC. She will be 19 in March--and it's likely our interview in Montreal won't take place before May. Does he include her or not? By the way, he won't be supporting her once we move to Washington although she will be living with us while she attends college. She has an education account, a modest inheritance and I earn enough to support her on my own. Please help. He wants to mail the 864 package as soon as the AOS fee has been marked paid (any day now!).

He doesn't need to count your daughter on YOUR I-864 but he counts both of you on YOUR DAUGHTER'S I-864. Both will be evaluated as if you both are part of his household.

Thanks. I'm just wondering if this may confuse things at NVC because he has two kids of his own that he claims as dependents and of course I've included their names on my DS230.

Oh, and does he need to do a full I864 package (complete with financials) for my daughter's package or will NVC just put two and two together? Both I-864s will be sent in one envelope.

Hi everyone,

My husband (USC) and I are having so much trouble with the form. He is sponsoring me and my 18-year old daughter (his stepdaughter). He sent in two separate visa petitions, one for me, one for her. Both were approved, the AOS fee paid, two cover sheets dowloaded (one for each of us--we have different case numbers--and now he is filling in the I-864 form. The questions: does he fill out just one form--or one for each of us? Part 3, question 9: I am sponsoring the following family members immigrating at the same time or within 6 months of the principal immigrant named in part 2 above (that would be me) and then adds: Do not include any relative listed on a separate visa petition. This doesn't make any sense--anyone else out there in the same position (USC filing for wife and stepchild)? Do we file two forms and two sets of financial paperwork? Can they go in the same envelope to NVC? Please help!

He fills out two separate affidavits. Although he is not technically required to send separate supporting documentation, I would advise it. It's just photocopies after all.

When doing both CR1 and CR2, the affidavits are tricky to complete properly. 9a should read none with the corresponding calculation at the bottom right of 9 stating 0 for each affidavit. On yours, he should be careful to enter 0 for spouse because you are already counted as the intending immigrant. On your daughter's affidavit, she is the intending immigrant and you are counted as spouse. Both directions I gave above are likely to seem counterintuitive. Follow them anyway. This ain't my first rodeo.

I just answered this in your other thread. The instructions are correct, even if they don't make sense to you.

Yes, both affidavits can go in the same envelope.

Okay. This seems to contradict another posting I read earlier tonight--which is why I'm so confused. I wish I had saved the link. The sponsor was told to put his wife and two stepkids on the same form even though each had a separate visa petition. But wait, why would he put 0 at the bottom right of each affidavit? He's checking off 8 so the answer to number 10 (Enter the total number of immigrants you are sponsoring on this form from Part 3, items 8 & 9) would be 1, not 0.
