Hello,

It is about time for me to file I-751 which will be in February 2011. My husband who is in the military is scheduled to be deployed in January till September. The question is if by chance we have to go to an interview, what should I do? Will there be a problem that he will not be there?

Thank you!

You need a copy of his deployment orders to bring to the interview/ include in the package that you file. A letter from his superior helps as well.

Already had to do this with my AOS and ill have to do it with my ROC too. Didnt get an interview at AOS because I submitted all the deployment papers with the AOS packet.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Just a reminder that the majority of Removal of Conditions applications are approved without an interview so the likelihood is that you won't be facing one. If it turns out you do have an interview, Inky has given you the correct information.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

p/s - Do I answer yes or no to the question 10? --- "Is your spouse currently serving with or employed by the U.S. government and serving outside the United States?" He will be deployed on the ship but his duty station will remain in San Diego.

Also, Should I have him sign the I-751 form before he leaves or should I sign the form and attach a power of attorney?

Thank you.

All military branches are given orders to be sent somewhere specially for deployments. They keep it for records because of deaths and legalitys etc.
