Hello Everyone. I apologize if this has already been stated somewhere else.. I searched but could not find the answers to my questions.

Today I have finally spoken to my criminal lawyer and it seems as if I will be waiting to go to court for sometime. I can leave the country if I'd like too, as long as I come back for court in 4-6 months. My husband and I miss each other terribly and are trying to figure out how to see each other. If I could leave the country I would automatically apply for a settlement visa to join my husband in the U.K. but due to my pending charges this is not possible. It seems as if this process could take a long time so we are probably going to file a cr-1.

My questions are:

1. Can my husband visit here on the vwp and us file the cr-1 while he is here?

2. Can we file the cr-1 before he comes for a visit on the vwp? He hasnt visited since May of 2010 (when we married) so I believe he would have no problem getting in.

3.It says that you can stay for 90 days so could we actually buy a plane ticketfor him to visit here on the vwp for 89 days.. without it looking weird?

4. Also, following our wedding I visted the U.K from May 21st - Oct 17th. I am thinking about visitng the U.K. now and then my husband visiting the U.S. when my case goes to trial. Can I file the CR-1 and then go and visit England on the VWP while it is processing? I'm worried it will look weird me visiting so soon again. I've even thought about buying a 2 week ticket and then changing it to a longer stay once in the U.K. Would this be ok as long as I got the 6month stamp?

Are there any other traveling arrangments that you guys would suggest? Has anyone been able to complete the CR-1 process without hardly being apart?

Assuming your husband is in the UK and the beneficiary...

1. Entrance and duration of stay is up to the CBP at the time of crossing. No guarentees that he'll be admitted. He should bring strong ties to the UK to make the crossing easier

2. Yes - have him bring a copy of the packet to the CBP when crossing

3. Sure - again, duration of stay up to the CBP at the time of crossing. Just because you have a return ticket with 89 days, does not mean he'll be admitted for 89 days

4. Visiting the UK is up to UK immigration. With pending criminal charges it may complicate your situation.

My husband was able to visit every month, however, the crossing into Canada was heaps easier as no visa or VWP required.

Additional Question: Can I travel to the UK and then file the I-130 from there. I know it had to be mailed to the US but can I just mail a packet to the destination or mail it to someone in the U.S. and have them mail it for me?
