So I have prepared all my AOS package with the exception of the I-693.

I went to the doc on Friday for the medical and he gave me the TB skin test. I went back this morning to have the test read but being from the UK, I had the BCG vaccine so I got a positive result. No biggie, I then had the chest x-ray done. What I didn't expect was that they told me they'd call in 3 days or so, for me to go return and go over the results.

I was hoping I'd be able to send off the entire pack today but I guess not.

My I-94W expires on Xmas day so I want to get the package in ASAP, should I send it in today minus the I-693, then send that in a couple of days or should I wait and send the complete package?

I wish I had more time!!!!

12-10-10 (Day 0): Posted package (I-130, I-485 and I-765)

12-12-10 (Day 2): Package received

You need to send it together with the AOS. AOS has no set time frame, as long as you married within the 90 days of entry you are safe.

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

The OP entered on the VWP (as evidenced by the I-94W), so AOS DOES have a specific time frame. S/he did not come in with a K-1 visa.

OP- You need to get the AOS initially accepted before the I-94W expires. This can take a week or two from when it physically arrives there. (I see usually 5 business days, but better give it more wiggle room). It sounds like you know that if you send it in after your I-94W expires you risk denial and deportation based simply on the fact that you overstayed your VWP (This is not the case for people who entered with valid visas).

One member recently sent in his AOS without the medical but has yet to get confirmation that they accepted it. I am not sure if they would initially reject the incomplete application or just send an RFE for the medical. If that member (Tim79 or something) gets his accepted without the medical, then I would also say you should send it in without the medical and wait for the RFE. But the doctor said 2 or 3 days? I might wait the 3 days... but it's nerve-wracking for sure. Can you call the doctor and request he go over it sooner if possible?

You know the risk, so what you decide is up to you. Hopefully someone who knows for sure whether they accept the package without the medical will chime in here. Good luck.

I just called USCIS to ask them, the chick wasn't very helpful and just told me to follow the instructions on the form eg it says file it all together so do that.

Its such a horrible waiting game. I asked the doc if he could speed it up but he has to wait on the blood tests coming back from the lab.

Nothing to do but hope and wait....

Thanks for your help and if anyone else has experience with this, i'd appreciate your thoughts

Howdy,

yes it was me that send in the AOS w/o the I-693.

The reason I did so was, that when I got layed off my company allowed me to talk with the immigration lawyers they normally use.

I was given the advice from an immigration lawyer to submitt the package w/o the I-693 (as there was urgency in my case as well).

Based on the information I got, USCIS might ask you to bring the I-693 to the interview.

But my case has not been accepted yet by the USCIS, even though they got the package 7days ago.

04/2006 - came to US as L1 employee

04/2010 - got married

11/2010 - submitted AOS package (I-130, I-485, I-765)

05/2011 - Welcome letter arrived in the mail

11/2017 - Filed for naturalization (Online Houston office)

11/2017 - Biometrics

06/2018 - Interview (passed)

06/2018 - Case approved notification

i would wait the 3 days, my reasoning is:

- It will take a day for them to get it

- around a week for them to properly process it

- when they process it they will most likely NOT reject it but if they do, they will NOT send it back via express post.. this takes it VERY close to your deadline.

So, wait for the results, send it all together EXPRESS post asap. It will take around a week for them to register receiving it. Assume 2 weeks to be safe so *hopefully* send it Thurs to arrive Friday.

I had the same problem like yours.But I waited to get my x ray's result and sent it along with my application. People from this forum said that it's ok if you send it out without I-693 and they will send RFE for sure.So it will delay your process.So my advice is wait until you get it like I did and send it out by express mail.

11/19/10: I-693 sealed.It means my chest x ray is fine :)

11/20/10: Package [ I-130,I-485,I-765] sent to Lockbox

11/22/10 [Day 1]: Delivered there

After hassling the docs office for days, the finally called me today so I went back, checked everything, signed it, received the sealed envelope as well as a copy for my own records, then I went to the USPS and sent that bad boy package! It should arrive Monday morning, now let the waiting commence :unsure:

Its probably the most stressful and scary situation Ive ever had to deal with.

Im so grateful to everyone on VJ for all the information and help that they provide people.
