I received this letter after our interview was denied. According to your timeline you didn't get to interveiw yet....but the DOS basically returned your petittion to the USCIS. Maybe they found a problem with it or the case wasn't CLEARLY approvable. Reviewing your case at this point would mean one of two things. They will either reaffirm your case and send it back on its way for processing, or you will recieve an action to deny. If they are denying your case then they will send you exactly the reasons for denial and they will give you 30 days to respond with further evidence, corrections, explanations....whatever they ask for. Once you submit your rebuttal they will then reafirm the case or deny they petition based on all the new evidence.

I recieved an action to deny three pages long (we have a hard case) and I sent them back literally hundreds of pages of evidence which they requested. So if they try to deny you...you could always send me a message and will give you some ideas of evidence that i submitted for my rebuttal. Good luck guys, hope isn't gone yet.

I'm really worried now,,a bunch of people from August filers received the same email. . .i don't get why they would deny mine. . .Im on my 4th month since NOA1. . . Actually,last year my husband filed a petition for me and my daughter. . .my daughter was approved and has an NVC case number. . .i was denied coz they sent me an RFE but we didn't comply coz my husband went back here in the Philippines to study,so when he went back to the States we filed another petition coz my denied petition was expired so USCIS told us to re-file. . .so I don't know if it has something to do with that or what. . .but other than that i don't see why I would get a denial decision. . .I haven't received any RFE so far, my husband called USCIS and they said that they've already made a decision (from CSC transferred to TSC Nov2) and we should wait for it in the mail in 30 days. . .my 5th month would be on January 14. . .

my fingers are still crossed on everything. . .thanks for your input. . .i hope to get in touch with in case something goes wrong at least i know someone

I hope the best for you guys. I was just giving you my particular experience with post decision activity. You really aren't going to know what is wrong with your case until you receive that letter. This system is run by people as well and there are many stages that our petitions go through and many opportunities to find something wrong or not clear. I am assuming you saw that message on the website. Your daughters case is at nvc but did yours get to nvc and then sent back.

In my case my husband was interviewed for the i-129f and our i-130 was at nvc. Once they found issues at the interview they sent both the petitions back to uscis for review. It took them an entire year to review my case as reviewing cases is not priority.

But never believe the computer. I would give both NVC, and uscis a call and make sure you talk to a person to find out what is going on. (the uscis hotline you just press the buttons that say you would like to report a problem with your case and that you lost your reciept #) You'll get an operator. I would particularly ask them why one of your applications is ok and the other one is being reveiwed, because they are related.
