My wife had 212(g) annotation on her immigrant visa. She received blanket waiver for missing vaccinations.

My question is : At the POE will she get a 10 year green card OR a temporary one year green card. Do we have to resubmit the medicals with completed vaccinations before we can get a permanent green card. Please suggest.

If you and your wife have been married two years as of the date of her POE she is eligible for IR1 status which means she would receive a 10 year green card.

If you have been married less than two years at the time of POE she would receive a 2 year green card and be required to remove conditions prior to its' expiry. The 212(g) annotation generally refers to vaccinations that are not age appropriate and should not have any bearing on removal of conditions on the conditional green card.

Thanks Guys. We have been married for over 2 years. Also on the visa it is written that at POE visa will be issued for one year, and asked to fill some form (some I5xx .. can't remember the number). Why did they write that visa will be issued for only one year? Are they referring to the green card stamp on the passport that they will put at POE and which is valid for 1 year?

POE stamp (I-551) is valid for 1 year, which acts as a temporary GC. But your actual GC will be for 10 years, since marriage is over 2 years at POE.

you have 1 year to cross the border...processed at POE..that's what that means...then she gets her real GreenCard in a few weeks of crossing at POE..at home address in USA.

Actually you have 6 months to POE..not a year. As Loto posted the visa is stamped at POE and is valid for a year which acts as the temporary green card. This allows you to travel freely until your actual green card is received.

I'm glad I found this. I was just wondering this myself why it was only valid until 09AUG2011. But that's 6 months! And when I get my real green card since I've only been married for just over a year, will last 2 years!

I was also freaking out about the 212(g)(2)(B)

But for anyone else who wants to know:

Section 212(g)(2)(B) of the Act which authorizes the granting of a waiver when the civil surgeon certifies, according to HHS regulations, that it is not medically appropriate for the applicant to have one or more of the required vaccinations.

I am no longer scared! :D
