Timeline

I received DS-3023 form from NVC, and also it attached a NVC #s. I paid $88 online last night. I follow guides from this site, and I am filling out DS-3023( as i am his agent) for my hubby through his email.I am also going to send the original DS-3023 back to China to him to sign it and express mail them back to NVC.So what I should do next? I have to wait for NVC to send me a package of i-864, or i have to fill it out by myself? What should it be on letter of employment?I also worry about my income that is qualify to sponsor my hubby or not? My income is around $21,000/Year<I took almost 2 months off this year to have vacation with my hubby>,and i have been putting some money to my IRAs's account monthly, it has 1800 bucks so far.I bought a house at beginning of this year,and i am on $142,000 debt. Can anyone help me to answer those questions? Thanks so much.

First off, it's DS-3032, not 3023 :P

You don't need to send in a hard copy of the DS-3032, you can just put the needed information in an email and send it off. Link: http://www.visajourney.com/wiki/index.php/Email_DS-3032_form

Don't wait for NVC to send you any forms or it could take weeks. You need to be proactive and fill out the forms yourself and send them in. Once your I-864 bill on the payment portal appears as PAID, you can mail in the I-864 package.

First off, it's DS-3032, not 3023 :P

Listing of assets is optional unless you're specifically asked to do so by a CO. The I-864 doesn't ask anything about debts that I recall ( just worked on mine yesterday).

I would go ahead and fill out the current I-864 and gather all of the other documents you know are going to be required. The HR department where you work should be able to do the letter for you. They'll probably respond more amiably and quickly to your request if you show them a sample letter they can go by, maybe even email them a softcopy with all of your information already filled in :) . This way way they just have to print it on company letterhead and sign it.

No but perhaps more importantly, you state your current income as what it will be for the next twelve months, not what it was for this calendar year.

Even more important is that you need to read and follow the electronic processing guides for NVC. It will speed your process by months.

NVC doesn't "need" all three. The only thing that is mandatory to send in is the recent year, 2009. The other 2 previous years (2008 and 2007) are completely optional. And don't worry about previous years you didn't meet the guidelines. NVC only looks at your current year and income. That's what they're concerned about. They don't care if you wouldn't have been able to sponsor two years ago. They want to know if you can sponsor NOW and in the future.

In my opinion, YES for the 2010 Tax return, 2009, and 2008 tax transcripts, and a letter of employment for 2011. Your income is not far over the proverty level. This year a friend of mine with an income a little more than yours, got a blue slip, and had to get a co sponsor, months of delay for the Visa. My income is barely over the minimum, with 2 houses paid for, and a large IRA. The Interview Officer said my income was "low". The income minimum is only a guide for the Visa Officer. Being over the minimum is not always what is the "real" requirement. I do not wish to sound negative, but Guangzhou is not always easy. Getting a Visa is the "descretion/personal opinion" of the Interview Officer. You may want to consider getting a co sponsor with a very good Income, it would save months of time, rather than get a blue slip. Best of Luck... :yes:

Because of where we are on the calendar, I would send the currently available information to NVC and then take everything you mention above to the interview in the form of an updated I-864. There' no need to delay sending the affidavit. NVC will leave it up to the Consular officer to make the decision.

You can have no tax return showing qualified income but document "current income" and pass but there's no guarantee on such a judgment call.

For example, I'm aware of a case where the petitioner recently took her first job as a Registered Nurse. I don't expect any problems even though she's never filed a tax return. On the other hand, I'm aware of a case where the last three years of income are all below the guidelines and the petitioner has recently upgraded from part time to full time as a clerical worker at a small business she's been working part time for. That paints a quite different picture. In the second case, I would strongly advise a joint sponsor.

Thanks for the advices. I earned around $21000 from 2008,2009, and 2010<I should have earned more in 2010, but i took around 2 months off to have vacation with my hubby. As you mentioned about a letter of employment for 2011, the 2011 annual income will be around $24000, with my IRAs $2000 + bank checking deposit $5000,and my house is in debt $142,000, do you think i still need a co-sponsor?
