RFE couldn't be delivered???

Hi guys,

So now we know where our RFE is: allegedly it couldn't be delivered. We did not move and all other NOAs and letters arrived. I just called customer service center and the nice lady said it will be resent to us within the next 30 days :( Can't they mail it off again today? I also wonder what happened. Do you think it's USPS? I verified especially the apartment number since we don't have names on our mailboxes in our community here.

Did it happen to you guys? Will they really need 30 days to send it again?

Should we still go to our Infopass appointment to find out what the RFE is about or won't they answer such questions?

You need to put your name on your mailbox or it will not be delivered.... also you may want to make an infopass appointment to get it resent... as the 0800 infoline has limited access to get anything done.... they are not USCIS officers... other have had better luck by getting their local office to re-request the RFE....

For your I-864, did you file just the recent most tax return (in line with the new rules recently published), or did you include more evidence. I ask this because I followed the new rules but just recently got and RFE saying that I should have included more evidence!!!!

to say I'm pissed off would be an understatement!! :angry:

but hey at least the RFE was delivered!? :P

Hmm hubbie did the affidavit of support. Since he attended college until June he did not have any tax returns. He then did research and found out that they *claim* it is sufficient to get his employment letter which states that we exceed the poverty guideline tremendously. He attached a letter explaining that. I wasn't too sure about that stuff, so I already talked to my mother in law and she agreed to be a co-sponsor. I assume that's what they want. I just emailed her to get the stuff ready, just in case!!!!

My other idea for the RFE is that they want us to send pictures and our story since I came on my J1 visa to New York and maybe they think we just met and married right away. But we are a couple since 2004. Maybe they know that and want a testimony which states that I intended to leave after my traineeship (heck yeah, we were boyfriend and girlfriend, serious, but I didn't know that he was ready to get married, honestly). So I gathered already the bill for the engagement ring which is dated May 23rd, obviously way after I entered the states. I also asked my in laws to write some letters explaining the situation - as I we did not expect a proposal! ;) So... I startet to write down our story and attached pictures, haha I'm bored without a job, and Paul wrote also his view on things. So we will have a book printed out on photo paper and I'll let it get bound, so that they will recieve a neatly bound and composed book.

Whatever they want, they'll get their co-sponsor and that book. Better be safe than sorry...

If you're on a J-1, the RFE might be asking for evidence that you're not bound by the 2 year rule 212(E). If you are required to leave the country for 2 years after your J-1 expires unfortunately even being married to a USC doesn't forgive this requirement. I don't wish to worry you, but its a possibility.

I too live in an apartment complex where the mail boxes are not numbered or named, and there is a notice there that states "property of the USPS - it is illegal to place stickers of any kind on these boxes". My guess has always been that the postmen do usually know the names, since I have received mail with my name and no apartment number listed. Why most RFE's are returned is a mystery no one can fathom... :huh:

I sent with my AOS package a copy of my DS-2019 which states I am not subject to the 2 year residency. But I only sent page one since it is there where it is stated. Maybe they want page two which is boring blablablabla. Let's see....

I just went to the leasing office and they said it's fine to put a name sticker on our mailbox, thank God. So most RFEs are returned??? Does it state on the letters someting like "only to perfect labelled mailbox"?!?!?!? I think it's so weird that just the last few days my AP arrived without any problem... :bonk:

So let's see if they update it online when they will send the RFE again or if we have to get on the nerves of an officer next Monday *lol* I am a panic person :blush:

Ugh, I dont think the mailman knows the names here - our mailing center has about 100 mailboxes for the whole community which is spread out.... And people keep moving in and out....

Most USCIS are returned undelivered because the persons name wasn't on the mailbox, just like yours wasn't - in almost all cases I've seen it can be tracked back to that. Usually in mailboxs you describe, one would put the name on the inside of the mailbox, either at the back on inside the door. The "stickers are illegal" thing is aimed at deterring people from posting ads on the mailbox for pizza and such I believe.

Write your name on a piece of paper and tape it on the inside of the mailbox door, if there is no slip or pouch already provided for your name inside (in most types of mailbox like this I've had in appartments there has been).

You're probably fine then. Probably best to stop speculating, hopefully you'll find out at the infopass what the RFE was about.

I think the deal is if you have no name on your mailbox you have a higher than normal liklihood of getting your mail returned to USCIS, so it won't happen all the time but it still can. They also have a returned request I believe that if the mail isn't picked up in 5 days from the mailbox it will be returned undelivered, so if you away for a while its best to get your mail held by USPS. Of course there's a third thing, which is just the crapshoot of getting unlucky.

Hi,

I am having the same "undelivered" problem with my green card. I applied for a green card, on a family-based petition through my husband. The whole process actually went quite smoothly. I had my interview on Jan. 19, 2007 and was told that my application had been approved. I was also given a letter stating that my application had been approved and that a green card would be mailed to me in 2 weeks to 2 months. Yesterday, I checked the status of my application online at the United States Citizenship and Immigration Services website (www.uscis.gov) and it states the following:

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Undeliverable document filed.

On February 8, 2007, the post office returned your document as undeliverable. Please call 1-800-375-5283 to update the mailing address.

Please note that I have NOT moved—I have been living at my current address for the past two years. Also, I have received everything else that the USCIS has mailed me throughout this entire process including interview date letters, finger printing letter, etc. Also, I rechecked the address that USCIS has on file for me and it is the correct one. I do not understand what could have gone wrong. My name is on the doorbell next to the mailbox (slot in door).

I need to travel out of the country in a few weeks. I went to the local USCIS office this morning but they told me that they do not stamp passports anymore and that I will just have to wait for my green card in the mail. They told me that it could take 30 days or more to have them remail it and there is no guarantee that it will not be “undeliverable” again. I have also read some horror stories on the internet about people never receiving their green cards in the mail and then having to start the process over again or file for a “lost/stolen” card.

What should I do? The woman at USCIS said I could go on my trip and have the greencard mailed to be by someone here once it arrives but that sounds too risky. What if it never arrives?

Help! Is anybody else in a similar situation?

Do you have an AP to use? That is the only other thing I can think that might save you.
