Hello,

Need to know how it works if my fiance (USC) and I, (after we are married and then I recieve my green card)

move to Russia (he might have to for a really great job opportunity)It might be for 2 years or so to

get the new company up and running. How would that work? I am unsure about the whole AOS thing and do I have to be

living in the US to keep this status? Don't I have to, in 2 years file for Removal of Conditions??

Hope someone can clear this up for us. Any help will be appreciated! Thanks

(not quite sure if this is in the right forum either....

It depends on various things, such as how long you'll stay outside the USA, and whether the job is US government related. If he knows about this job opportunity now, is it not likely that he'll take it up before you even get your interview, let alone get married and do AOS ?

Generally, if you already have your greencard and it's less than two years you should be ok, but will need to apply for a re-entry permit before leaving. If it's more than 2 years, hand back your greencard, then apply for an IR-1 spousal visa via DCF once you are ready to return.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I agree with Penguin

Getting a green card means you need to live in the US. Now that doesn't mena you cannot travel out of the US. You'll need a re-entry permit (DO NOT leave without having already taken care of this) but this is only after you've received your green card.

if you're looking long term living in Russia with this really good opportunity, then file DCF when the time is right for you to move back to the US and get your green card while in Russia

Good luck

OR, once she has GC, she can file for expedited naturalization IF USC spouse is working for US employer in Russia - falls under 319(b) naturalization option.

I know there are many members who are living overseas due to the USC spouse's work. I'm going to move your thread from K-1 Process to Effects of Major Changes to see if you can get their input there. In the meantime, here is a useful CBP link:

Thanks for all your help, guys!!!
