K1 Filer - what is the difference between I-134 and I-864

Hi,

My fiance received the letter from the HCMC US consulate. It told her to download the instructions for packet for IV instead of instruction for K.

Instruction for K pdf shows we need I-134 but instructions for packet IV shows we need I-864.

Does anyone know the difference between these forms? Are both OK for K-1 Visa?

The I 134 is usually used for a K1 affidavit of support and requires 100% of the poverty line the I 864 requires 125% and is needed for AOS. Some consulates use the higher level upfront knowing you need to reach it for AOS.

This will not be over quickly. You will not enjoy this.

IV = Immigrant Visa

K-1 is a NON immigrant visa (NIV)

I strongly suspect they told you to download the wrong packet. Send an email to the consulate and ask that they clarify this. Expect a couple of weeks before you get a response. I haven't heard of any K1 visa applicants at the consulate in HCMC being asked for an I-864 lately.

It's against DoS policy to require an I-864 for a K visa, even though there are a few consulates that do it.

05/01/2013 - Removal of Conditions - APPROVED!

Thank you, Jim. I thought so. I am sending an email now. One quick question... My fiance is heading to the HCMC consulate window on Monday to turn in the DS-230 Part 1 and DS-2001. I noticed that the IV instructions and the K Instructions have a slightly differenct version of the DS-2001. Would you recommend I have her turn in the K version even though the letter said to follow the IV version?

Appreciate your advice.
