Hi, i am on b2, and planing to change my status to f1 to do my masters, My i 94 expires on 7th of dec 2010 and my classes start date is 6th jan 2011, i heard we have to be in status atleast 30 days from the start of the classes date.

1. Am i eligible for a change of status from b2 to f1 now? am i short by a day?

2. Will my b2 get revoked if my COS request is denied as il over stay untill i get there decision?

3. is COS tough nowadays? should i just go home :(

You should speak to somebody from your school who assists the international students in obtaining the F-1 visa. I am sure you will get all the help needed. I hope you have a sponsor.

The following answers from my own experience as I have been in your shoes before:

1)You can change your status from B2 to F1 except you have to have at least 45 days of stay left on your I-94. I think you are far too late.

2)Technically no but it might cause problem later on which you can avoid.

3)toughness is not the problem it is the time that it can take sometimes. You can expect to have an answer anytime between 30 days and (as I have seen in some cases at my school) 6 months.

In essence, if you do want to start your classes January 6th you would have to go home NOW. That means of course staying lawful with your B2 status. Assuming you already got accepted in a school and got your I-20 issued, make sure to take it with you and all other supporting documents. Once you arrive to your home country schedule an appointment at the U.S. Embassy for an F1 visa. F1 visa applicant have priority scheduling appointments as they understand the critical timing needed sometimes for the first day of class. You can practically have an appointment at your embassy 2 days from your arrival. In my case, cause I was tired as well, I arrived to my home country Thursday and I did my F1 interview the following Tuesday. I would not worry about the interview if you are already accepted at a school. My interview for the F1 lasted 30 seconds as they knew I just arrived from the U.S. and I was back mainly for the F1 visa.

A couple of advantages in my own opinion for the F1 visa route than the change of status:

1)You can visit your home country between semester. With AOS, if you leave your F1 status is revoked and cannot reenter without a visa.

2)Fast appointment and fast decision (You will sooner if it is a yes or no)

3)you get to keep your B2 visa valid as well.

Also like juliava mentioned, the school at which you will be attending should have a specialized Admission Officer for international students who is supposed to help you with all of this and explain to you your options. Also they are responsible for following up on you as far as taking the minimum credit hours every semester and so forth.
