Hey everyone! I am currently applying for AOS, coming from a K1 visa. Im a little bit stuck on the I-864. I received some good advice just recently, and would love any more of the same!so nervous to get these forms right!

-As my wife is a student, and therefore has no income, I realize she is still the main sponsor, but do I just ignore most of the form when it comes to her finances etc? her mother is filing a I-864A to reach the income requirement, so there is no problems there. Just wondering what I should do, and is it ok to discard some of the questions it asks her on the 1-864?(asking her for tax forms she wouldnt have etc...)

-Also, on one of the questions, it asks for household size. I have to include myself in (a), but then it asks if she is married, and if so right a '1' in the box (we are now married, so i put a '1' in). So when i add up the numbers to get the household size, I get one more than it actually is. I know it says not to count twice, just if someone was able to clarify it that would be amazing!

Any help would be amazing, and if i can help anyone at all, just let me know!

02/14/11 EAD in the mail!!!!!!!

02/17/11 EAD in hand + applied for SSN

04/13/11 Interview and Approval letter, card in production!!!

well the 3 first boxed check first for you, second for her ( i don t think you have to put 1 it s already written ) and then nothing else. Remember that it s your wifes form so don't sign or anything

well count your MIL if she is part of the household

Read the form instructions carefully. The answers you seek are there.

If she's not employed then she should check box "d" for question 22, and enter the date she became unemployed. If she's never had a job then put the day she was born. :P

For question 23 she should enter "$0". For question 24.a she should enter "$0", and for question 24.b she should enter the amount from your step-mom's I-864A. Question 24.c is the total of "$0" and the amount from mom's I-864A. Check box 24.d since mom is submitting an I-864A (make sure mom includes tax returns or transcripts and proof of her US citizenship or LPR status).

If she has not filed tax returns then do not check any boxes in question 25. She needs to provide a letter explaining why she wasn't required to file. Being unemployed is a good reason.

Do NOT put a "1" in the box for "married". Look at the heading for that section. It specifically says "Persons NOT sponsored in this affidavit:". You are already included in the section titled "Persons you are sponsoring in this affidavit:".

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Hello,

My fiancee may not have the sufficient requirement to sponsor me because she has just finished studying also. I wanted to put another sponsor, her sister. Her sister will have to fill I-864A form (and not I-864 ?). Is this correct ?
