I see what you're saying, mo. I think it's probably just a matter of style.

I think it might be my perspective of what the I-864A does. And it might be an erroneous one. True it joins the income of household members related by birth, adoption or marriage but in my mind (and maybe only there - LOL) one would use the A attachment for a 'snapshot in time' of a more permanent arrangement between household members.

Regardless, I'm thinking at least one thing Paul erred in was by sending just the tax return and not the attachments. The cite in bold that he keeps referring to in his other thread doesn't actually say to include the W-2s.

This is what I just wrote in reply to the same in the other thread:

You know the thing about 'temporary' arrangements---they have a way of stringing themselves out.

I just don't know how one would ever define 'temporary' vs 'permanent'. And if you've been living there for, say, two months, and need to file, but don't know when you're moving out, or to where, how could you answer it? It's like the part about proving that your income will be 'ongoing'. Who among us know how long we'll be employed *anywhere*?

I'm still not clear on what Paul included or not.

If copies of the tax return are sent, the instructions are clear *everywhere* that W2s/1099s must be included. If using transcripts, no need for them.

The problem with following just the memo is that those are not the complete instructions, and in *every* instruction discussing "tax returns" it is clear that the "return" is not complete without its attachments (W2s/1099s). IOW, by definition a "tax return" includes W2s. Yodrak is one person who has belabored this point for a long time and the new forms make it abundantly clear.

The memo is really pointless for someone starting out with an I-864 today: the instructions appear to have been updated everywhere.

The RFE states:

The household member on form I-864 Affidavit of Support/Form I-864A Contract between sponsor and household member must submit the following:

1. Federal income tax returns, W-2s, 1099s, and all schedules submitted to the IRS for the most recent tax year or certified Internal Revenue Service copies.

Paul: the "household member" is Mom.

What did Mom supply in the way of tax returns?

She supplied a photocopy of the 1040 and W-2 for 2005

If photocopies of the 1040, I believe they want you to include ALL attachments, including W-2 and 1099. If transcripts, I believe those are not necessary.

You really think transcripts are not necessary?

IMPORTANT: Does Mom file her tax return jointly with a husband? If so, and Mom did not clearly show which of that jointly filed income is hers alone, this could be the issue.

You may be right, her tax return IS filed jointly with her husband, how do you show which of the filed income is hers though?
