My fiance, has had a clean record. But yesterday, he tried to return a piece of clothing, and long story short, because they would not let him return he, he bought something cheaper and tried to return the more expensive item. At the store they called the police and he was at the station for 6hrs. He realised he shouldnt have done this, and it wasnt with any criminal intention. The police let him off, but put a warning on his record under "FRAUD and misrepresentation". He has an interview TOMMOROW! and im so worried that they will denie him visa. I told him, to be honest, and let them know if they ask him. Does anyone know what is the best way to deal with this. Is he most likely going to be considered as INADMISSABLE now! please advise.!

Ummm...if his interview is tomorrow, I assume his police certificate is already with the Embassy? Or he'll be submitting it at the interview tomorrow(sorry, don't know how fiance visas work)??

Point is, he must have obtained his police certificate a while back - and it shows a clean record. So how would they know at the Embassy about something that happened just yesterday if it isn't on the police certificate that he has submitted/will be submitting to them? Relax - the Met Police isn't going to call the Embassy to let them know - do they even know he's applying for a US fiance visa?

Do you get my point? You're panicking without reason I think.

Now, because I'm going straight for a spouse visa, I don't know the procedures for filing for AOS from a K1. Is a new police certificate required then? Or are further background checks involved? If so, that may be something that comes up then. But I don't think a new police certificate would be required to adjust status.

July 25, 2013 - 10 year green card APPROVED!! (notification via text and email, and website updated)

July 31, 2013 - 10 year green card received in the mail!!!

AOS does not require a new police record. Police records are generally brought to the interview. If they happen to look up his record while he is at the consul he might have issues.

I forgot to mention. The warning will be on his record for 3 YEARS

There are no such things as warnings on a persons criminal(PNC) record. This sounds more like a formal caution which is more serious than just an unofficial warning.

And then there's always the fingerprints the CBP might take at the POE when he tries to enter with his visa. They (CBP) can find him inadmissible even after his visa is issued and they can cancel his visa and he won't be allowed to enter.

Thanks all. Just to update. My fiance had his interview today. He mentioned to them at the end that he did get the caution. The officer asked to see the police report (which he took) and the officer told him because it was a minor caution he would be ok. He gave him the visa!!!! He did then make an amendment to the form, that my fiance admitted his wrong doing without anyone asking him, and that it was a minor caution.!
