hello,

I went to my biometric appointment this morning it was scheduled at 9.00am in Charleston SC (we drove from Savannah GA)

when we got there i presented my appointment letter and my passport aand the agent asked me if i brought my marriage certificate since i filed under my maiden name but my passport is under my family name . I said i didn't since in the letter it only said to bring a picture ID and the appointment letter ....

So he asked me if i knew anyone who could fax me my marriage certificate and i said no.

He said it was ok that we will go thru the biometric but he would do it under the name on my passport ,i asked him if it would be a problem in the process later on.... he said NO i just had to tell them i wanted my maiden name during the interview in my green card .anyway while he was fingerprinting me i told him my lawyer had my marriage certificate and that maybe i should call him to fax it ...he reassured me and said oh no you will be fine your name will appear on your working permit but once you go to the interview just tell them you want it changed to your maiden name .

SO I WENT THRU THE BIOMETRIC AND LEFT BUT SINCE THEN for some reason iam worried that it could be a problem .

I need someone to let me know if that agent knew what he was talking about .I tried to call USCIS to ask about it can't get no real person on the line ....

THX IN ADVANCE iam really worried

no need to fax your marriage certificate,your appointment letter says applicants must bring their permanent resident card alien card,or passport, driver license,state issued ID, or military id, it doe's not say marriage certificate, you had your biometrics taken thats all that matters, your go to go good luck,

Yeah.. you have a right to be worried. This means they have most likely changed your name on the system to your maiden name. Meaning your greencard will arrive in your maiden name. As it seems you sent your paperwork in your married name, I know this is something you don't want. To get a new card you would need to pay $300+. The reason he told you to tell them YOU changed it is because if he's the one that changed it (and not you) then you can get a FREE replacement card to fix it. If you admit it was you, then you need to pay for it.

You should call the 1800 number to double check what name your file is under now. You should ask to speak to an immigration officer, that's not what the person who answers the phone is. If it's been changed to your maiden name you should ask them how to go about fixing it. You MIGHT end up having to make an infopass appointment or something.

ok just realized maiden name means your name before you get married ( my english not perfect)....

and i though it meant the contrary . SO let me rephrase this .

I filed under my husband name but my passport is under my maiden name .

The agent took my biometric under my maiden name (which doesnt match the name i filed with ).

I dunno if its clear:(

little miss, you mabe right but,the asc appointment letter is address to the name on the appointment notice,should match your ID,THAY SHOULD accepted the picture ID with the same name on the appointment letter, sorry that happen to you,

It's clear :) Don't worry that's what i assumed you meant.

My previous answer still applies. It seems that he changed your AOS documents into your maiden name (name before marriage). Because you didn't have any proof of your name being your husbands name now (the marriage certificate) he changed your AOS documents to your maiden name (name before marriage).

As I said before:

Finally got to talk to someone from USCIS who was nice but obviously didn't know.... she just said that if it was a problem they would let me know then i asked if i could speak to a supervisor and she said that noone of them were available at this time and to call back in 2 or 3 HOURS!!! ...Needless to say it wasn't helpful at all.

hi,

it should not be a problem, you did not do anything wrong. if they needed your marriage certificate - they had to put it on your letter, and since they did not have it, it's not a problem.

I had my biometrics last week and I also have my documents under my maiden name and changing it to my married name, but the lady at the biometrics didn't say anything about it.

shouldn't worry about it, just let them know you want your name to be changed to your married name when at the interview just like that man said.
