OK, but they would not even let her apply today, and they KNEW about section "C" when I showed the printout. It's not the need to work, but rather the health insurance that is a concern.

The SS woman said her computer would not let anything even go through without some work authorization number. (Stamped on VISA or EAD).

So, I guess its ~$1000 for the AOS and another $380 for the EAD.

You do not need a SSN or ITIN for Health insurance, there is no law that allows insurance companies to require either of these numbers. You do need to be married, once married file life status change with your insurance company and she is covered. To many people think SSN is required for so many things, but in fact it is not. Only the government can require you have this number for taxes or work authorization. No private company be it insurance, credit card, banks can by law require you have a SSN or ITIN.

True, but if a business or other enterprise asks you for your SSN, you can refuse to give it. However, that may mean doing without the purchase or service for which your number was requested.

Thanks everyone. We may go back to the NH office since it is not far and try being as stubborn as they are. If that fails, we'll try Massachusetts. I think there is an office 30 minutes from here.

OK, so as it turns out, there WAS a work authorization number on the back of the I-94 stapled inside Shamim's passport. I never saw it, so shame on me there.

So, today we go back to the SSA office in NH and get a different woman. She doesn't even ASK about the work authorization. As soon as she looked up Shamim in the computer, the SAFE system already had her in there as work-authorized (temporary). Had the first woman lifted a finger to help us, we could have saved a trip and a lot of headache.

Bottom line, SS card is coming in 2 weeks. :)

Yes. Still some grey area however. We wanted to apply direct with her new married name, but they said they could only apply the first time with her name as it appeared on her passport. Fair enough. But then she said we would have to go through homeland security to get the legal name change. Maybe she was referring to the AOS process??? Then she said after that, we could go back to change the name on the SS card.

2. Foreign born individual

A foreign-born person’s legal name is the name shown on his or her immigration document (includes hyphens and apostrophes).

The only time you may process an SSN application in a name that does not agree with the name shown on the immigration document is if the person legally changed his or her name after the immigration document is issued. In these situations, the legal name is the name shown on the evidence of the name change.

Not necessarily. If you look at the OP's timeline, they are not yet married. Therefore, she does not have any legal justification for having the name that will be her name after the marriage on any document (social security OR immigration).

Yeah if they aren't married, she can't apply with the married name. I just assumed they were married, when he said she wanted to apply with the married name. How could anyone think they could apply with a married name before they are married.

We went to one office around 46th and Ashland in Chicago back in July. My wife came on a K-1 and still had over a month left on her visa. They would not give her the SSN at this office. I even had the printout with me and they argued that their policy said something else.

After that we went to the office in downtown Chicago and they gave her the SSN with no problems.

Because of the way the computer systems are set up it is best to apply for the initial social security card in the name on the K-1 paperwork. After you receive the EAD and/or green card showing the new name there should be no problem obtaining a new social security card with the married name as the new name should be in the system. Big note on the should be's.
