Does anyone know, how recent the letter from employer ( which has the date it was prepared) has to be for I864? does it have to be within the week or month of sending the I 864 ?

1-2 months prior would be acceptable..

by the way i see your priority date is Nov. 3, 2010 and the NVC requesting the AOS from you... this is good. thank YOU for updating your timeline.

No problem... NVC hasnt requested the AOS YET, I am just keeping it prepared cause I need to leave the country.. so when they do request it, I will have my family from here mail it to them. That's why I wanted to know how long the employement letter is good for(Validity).

Hello there,

I came across this post, and thought I'd put my story too :) U've said in your post that " for I-130s in the F2A the NVC has been sending the fee bills and requesting the forms even though the visas are still far fromavailable."

I emailed NVC asking the same thing...plz read the following: disappointing, but what can be done?!

I just wanted to inquire if me and my husband could mail the necessary documents and forms to NVC, example: DS-3032, AOS, DS-230, even though our case is on hold since my husband is a LPR. I would greatly appreciate your response in regards to this matter.

Thank you,

Sincerely Yours,

Your inquiry has been received at the National Visa Center (NVC).

Any documents received at the National Visa Center that have not been

requested will not be reviewed and may be returned to you. Please do not

send any documents until they are requested.

We updated the mailing/email address for this case. Please continue to

notify the NVC of any change of mailing/email address, or change in

personal situation that may affect the principal applicant's entitlement

to a visa.

Due to the numerical limitations on immigrant visa issuance prescribed

by law, this petition is not eligible for further processing at this

time. The petition will be retained at the NVC until an immigrant visa

becomes available. The petitioner, principal applicant, or attorney of

record will be notified when this petition is eligible for further

processing. The principal applicant should not make any firm plans such

as disposing of property, giving up jobs, or making travel arrangements

at this time. For additional information please review the explanation

of numerical limitations on immigrant visa issuance below

SO WHATS THE DEAL??? THIS IS SOOO FRUSTRATING! GOSH!I'D APPRECIATE YOUR RESPONSE :)CHEERS!

kevinjj33,

Thanks for following my Facebook page. Although it is a bit embarassing that I mispelled 'volatile'.

To everyone else, here is the deal. The normal proceedure is that after the I-130 is approved, USCIS sends the file to the DOS National Visa Center. This takes about 4 to 8 weeks. If a visa is not available when the NVC receives the file, they send out the letter telling you that you have to wait until a visa is available. They will later send a Choice of Agent letter. Then when the petition is near to having a visa available, the NVC will send the fee bills. When the fee bills are paid, they send another letter telling you to submit the I-864 and DS-230 (they are transitioning right now from the DS-230 to the online version DS-260). Once the NVC has everything, they will send the file to the consulate.

Recently I have been seeing that for I-130s in the F2A the NVC has been sending the fee bills and requesting the forms even though the visas are still far from

available. So I called the NVC and got the answer that is posted above.

You dont have to feel such. We are on the same boat. Actually, we havent received any request documents yet. We also tried emailing the NVC but we got the same response. As you can see, members here have PDs from OCT 2010 - Feb 2011, but still waiting since NOA2. Most of us decided to just make ourselves busy rather than feel bad seeing nothing happens. There are lot of people out there who have waited years for their approval. We are lucky enough to be processed in 3-5 months average. All we have to do right now is wait, let's pray that everything will turns out fine.

P3AU is an email from NVC stating that no visa is yet available for your use. We felt the same too. That's why I recommend you make yourself busy, like preparing the necessary documents, so when the time that NVc will be asking you to send them, they are already done. About the people who got processed by the NVC, i cant answer you that. Just keep praying that soon you will be processed. :-)

Sorry for bothering... :)

you think that VB won't retrogress now??? like it did before...since the past 3 months its only moved 1 month...hence Feb 2009!!! omg im going crazyyyy :( help!

I dont know. But some says, it is a way of the DOS (moving of VB of atleast 1month) to keep from retrogression again. We rather like to move it that way than retrogress.
