Living in US, contracting with foreign company

Ok got a weird question. My fiance is finally coming out on the 7th (a week :D). But his job in Japan was basically freelance. Now, he's got a job that knows he's moving to the US and is fine by that BUT they're insisting on putting his US address on the work contract. My question is, even if he doesn't have a work permit yet, is he still able to 'legally' do this job? Since the company is not an American company? And will he have to claim this income on his US taxes when the time comes? Thanks :)

You will find a lot of Canadians and UK citizens (including myself) who continue(d) to work for employers in their former country after moving to the US. It is perfectly legal. Yes, you will need to report the income on the US taxes. Some countries have a tax treaty with the US so you will need to research that part of it. You will also need to research how he is to be taxed in his former country. You may try asking in your regional forum if anyone has done this.

How are they paying him? In Yen or Dollars? If he's getting paid in the US that would make him a US contractor and subject to US law.
