Hey guys, hope all is well. I am currently applying for aos, and I am starting my last form, the I-864. Just had a question:

My wife is obviously the main sponsor, but as she is a student, my mother in law is my other sponsor(main one financially). just wondering which boxes they tick on the first question?

Any help would be amazing!!

Thanks

olly.

Wife checks box A. If you and your wife don't live with your mother-in-law then mom fills out an I-864 and checks box D. If you DO live with your mother-in-law then mom can file an I-864A. The form is a little simpler, but mainly it allows the household member (mom, in this case) to combine income with the primary sponsor to help them qualify.

I'm adjusting from a k1 visa. Although I have the 2 sponsors( my wife and mother in law), my wife won't be contributing anything, and my mother on law will be the full financial support if this helps. What you think?

Thanks for the support so far!

That's fine. The primary sponsor doesn't need to have any income to contribute in order for the joint sponsor to be able to use an I-864A. They just need to live in the same household and be a qualifying relative. The I-864A is a bit simpler because it doesn't contain any of the household size calculations.

Ok, so my wife files an I-864, and checks box A, even though it was a I-129f she filed and not an I-130 as the intructions state? And then my mother in law files a I-1864A as we do live with her?

Is this correct?

Thank you so much so far.

Yes. Box A is the one for petitioners (primary sponsors) of family based visas. The other categories have to do with employment based visas, joint sponsors, and substitute sponsors, none of which even remotely apply to a K1. Your wife should list your mother-in-law's income (from her I-864A) in section 24 of her I-864.
