hello everyone, my fiance didn't file his tax returns for the last two years, he was too busy working for the military, having read the threads in there, i found out it's one of the documents that needs to be presented during the K1 visa interview at the embassy, but my problem is i can't present this at all, cos he didn't file the same for the last two years, but he is still on active service now. My question is can this be dispensed with because he'll be with me during my interview so he can explain why i can't present his tax return to the consul. Anyone here who has been in the same situation, please let me know any advice would be highly appreciated. Thank You!

A US citizen is required to file a tax return each year unless their income is below a certain level. Since the military offers free tax assistance I find it hard to believe he didn't have time to file his returns.

Even if somehow you were able to get an approval for the visa without the tax returns they will be required for filing for AOS when you arrive in the US.

He needs to find his pay records and file his taxes ASAP.

No, he will have to file his returns. Have him take care of this as soon as possible so you will not be delayed in obtaining the visa.

No American citizen is too busy to pay their taxes. He will have to file back taxes before you are granted a visa. There is no explanation that will satisfy the embassy. There is a reason they require the submission of the tax forms.

Filing the back taxes isnt difficult & should be done now. He can get assistance from his command.

Agree with everyone else. My then fiancee was in the Marines for 4 years, he was in Iraq and other dangerous places and STILL filed his taxes. It's not a "if you feel like it" it's a must.

Yes you're right, he should really have filed it, i told him to do it but i don't want to keep telling him and add up to his stress at work :( He was deployed overseas that's why maybe he didn't file his return, or it could be that he's just too lazy to do it. He wants that I be the one to file his return once were married. Oh no, looks like it's going to be a big problem. Good luck to my getting the K1 visa :( Thank you for the info. :(

Thank you so much guys, i have been convincing him to do it now, but sometimes we just fight about it and it just upsets me more, btw, how long should it take to file a return? I don't think this is really a good time for him to do it as he is too busy in the AF preparing for the retirement of his boss. Oh no, looks like i need to prepare for the worst, saying goodbye to K1 visa if things get to worst and he wouldn't file his tax return. Oh well.....:(

What? He wants you to file it for him? I'm as lazy as any guy but wow that seems amazing even to me. :bonk:

It takes like 15 minutes if you use some form of tax software. Especially if you don't have any major assets, property, etc.

May have to say goodbye to the K1? Due to not being bothered to file taxes? I'm missing something here.

Yes, he's lazy i guess, he's holding a one deep slot at work that's why he's too stressed. There's no problem with me, i can file it for him once were married but i need to get my K1 visa first before i can do it as his wife, but that is if i can convince him to file his tax return, i just don't think this is the right time, he's damn to busy with work, but if he doesn't want to do it, i can't do anything right? I know his temper, and i don't want to push his buttons. We'll talk about him tonight. Thank you so much, hope it will be alright :)

You being his wife has nothing to do with him filing his prior years tax returns, he will still be listed as single and file accordingly. You can do all the paperwork for him if you have the knowledge, a straight forward return takes like 15 mins as said previously, and then he signs it and mails it.

There is something else going on here, perhaps he owes back taxes or child support? No one just doesn't file a tax return for years because they "are too busy".

My ex tried to play the I am too busy to file game. Happily it was after we divorced. When they caught up with him the fines and back taxes added up to over 100k. They attached his paycheck and left him with only about 500 a month and he was making over 60k a year at the time. It is a very very bad idea to ignore your taxes.

This will not be over quickly. You will not enjoy this.

If he really loves you and wants to be with you, he will find the time and money to file his taxes... We have time for the things that we choose to make a priority in our lives.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

My fiance also falls into the "lazy" category and hadn't filed in two years. Once, I told him how it was mandatory he did it the next day online and ended up getting another 600$ back! Your fiance may even get some money back as well! It may be some extra incentive to file.

April 2008: Met through a friend

April 2009: Started dating

July 24, 2009: Engaged!

Feb 25, 2010: Sent in I-129F

Mar 11, 2010: NOA1 received

July 02, 2010: NOA2 received!!

July 07, 2010: NVC receives case

Aug 04, 2010: Received Packet 3

Aug 06. 2010: Packet 3 Sent!

Sept 14, 2010: Packet 4! Interview time!

Nov 15, 2010: Medical in Montreal

Nov 19, 2010: Interview in Montreal

Interview Result: Approved!

Dec 30, 2010: Moving Day! POE at Calais, ME! Never have to be apart again!

But our 20 year-old daughter hasn't filed in 2 years, despite the fact that she never has money and would get money BACK from the Uncle Sam. Maybe, just maybe, he isn't required to file taxes for the last two years. Combat Pay is excludable and is not reflected on his W-2 if accounted for properly by the military. He may be entitled to a refund and still not be required to file his tax return. It would be a good idea for him to file for immigration purposes but it may be that he is not required to file for income tax purposes. Here is a link to an IRS publication that might be helpful:
