I hope they do not pass the decision to eliminate overseas filing of I-130. Not to hurry anyone up, as I understand we all have different circumstances and situations, but anyone thinking of doing it soon should move forward if they can just to be on the safe side. :(

Hey there...

I don't believe that you (we) have anything to worry about... AFTER ALL it is only 8 days (almost 7) until the 9th of December and honestly and truly...there isn't anything gonna happen in that short period of time... Do you have everything ready to go once that date is here? In the meantime, check, check, double and triple check EVERYTHING is all that I can say....I am sure that once a DCF has been filed they will have to go forward with it. So try to relax (I know, easier said than done) I have not sent our's off either, BUT will soon and I am already on Pins and Needles as I am a worry wart. We will see this process through and then we will ALL be happy and with our HUBBIES forever and in your case your Lil one too!

yeah and then theirs the part about the language used on my local consular office site regarding residency requirement. "continuously residing in consular district" having a friend say nooooo that means you have to be resident and others saying that is from the day you arrive

thanks though, i needed that. i just wish this all be over with. we haven't got our translations done yet as my hubby has not been getting much work lately and not sure how we going to pay for it all so i guess i will see. my hubby says don't worry, don't worry i will get it...well, umm sorry but worry is what i do.

thanks much.

here goes

http://cairo.usembassy.gov/consular/iv003.htm

1- The petitioner is a resident of the consular district. The Consular section is allowed to accept I-130 petitions from U.S. citizens who reside within the consular district and have done so for the previous six months.(here is where my confusion lies in these two)

2- The petitioner must have maintained continuous residency in the consular district a minimum of the preceding six months in order to demonstrate residency.

not sure if that is saying lived here since 6 months or actually need to be a registered resident

What I believe it to mean (as it did here in Turkey) is that you have to be a "Resident of EGYPT for 6 months which means that you must be a legal resident... I had to get a permanent resident card as my Tourist Visa was only good for 3 months at which time, I either had to leave the country or obtain my Resident Permit, which is good for a year. This is what I know for TURKEY...and from what I gather on your link, it is the same BUT I could be wrong...when it says RESIDENT, That means that your not a TOURIST per say. What are the Visa requirements for EGYPT? They may be different than they are here....

I know that in Morocco, you have to be a legal resident holding a residence card for 6 months in order to file DCF. You should call the consulate to be sure..

Hi everyone.

I think it can be said that we all worry, these immigration processes affect our lives directly so I don't know how not to be worried. But fortunately we can all find some comfort here at VJ, having other people's support and feedback to help us along the way.

The more information one has, the better... so I would recommend contacting the Embassy directly to learn how they define residency and what documents they want for you to establish it. Every Embassy works differently, you would be surprised. So, go ahead and ask. Information is power. :)
