Hello i would like to know if there are more couples in the same situation as we.

We got married in Baltimore in 2006, after that we moved to the Netherlands, but it did not work out and my husband hade to go

back to the States, we kept close contact true the computer and traveling but that was not the life we wanted.

So in december 2009, i moved to America and we went to a layer for my papers, all went well and really fast i got my travel papers,

social security and EAC.

Then we hade our interview in Baltimore, on 5-2009, and after that nothing, the interview went well and the officer was kind,

he said mabye you have to come back for a second interview thats up to my supervisor, we hade all the papers in order, only thing he was asking

was, are there more joint papers like a joint bankaccount.

At that moment we did not have a joint bankaccount, we did however have a joint healtinsurence.

The officer said you will hear from us in about 30 days, wel we never did after 3 months we went for a infopass, and again nothing the lady

there told us the case was still pending she could not tell us why. She did say wen your EAC expires make sure to get a new one?

I am getting worried now we are still waiting for a answer, if it is approved or for a stokes interview.

Are there more couples that have to wait this long?

It's not the norm, but it does happen. About the only other thing you can do is have your husband contact his congressman or senator. They may not be able to get any more information than you've already gotten, but they can usually get status updates faster than you can.

There's apparently something in your file that makes your case not clearly approvable. In those cases, they either wait until they can either clarify the issue and approve it, or confirm their suspicions and deny it. In the meantime, you're in limbo.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

If you entered in December of 2009 do you mean your interview was in May of 2010?

Did you enter on the Visa Waiver Program?

If yes, was your NOA1 Dated prior to your authorized stay expiration?

If not then you would fall under the group of AOS Filers who are also VWP Overstayers and that has become a problem for many USCIS offices lately.

Hi again,

I entered the States on a visa waver program correct.

In the same month we went to a laywer, and filed all papers.

The papers where in office on time (before the time i should have gone back) and also the officer we spoke to in Baltimore,

did not ask anything about that he did take my I-94 but not my EAD.

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to "Adjustment of Status from Work, Student, & Tourist Visas" as you are adjusting from the VWP and the prior forum is for K1, K2, K3 & K4 **

Hi Bob4Anna

No i did not intent to adjust status, wen i came here in december 2009 my husband and me where so tired of beeing apart

from each uther that i desited to stay, thats wen we went to a lawyer and filed for papers, this all hapent in Januari 2010,

thats wen the papers where brought in order and taken to the office in Wachington by the laywer.

My VWP was till march 2010 and the papers where in office in time so before the date my VWP ended.

Please explain what POE is? if it is the border or the officer that we hade with the interview, wel no there where not any quiestions ask.

POE = Point of Entry.

As long as your weren't question at POE and answered in ways that contradict anything in your I-130/I-485 packets AND have a NOA1 Dated before the expiration of your authorized stay them you shouldn't worry about anything.

You should schedule an infopass appointment at the Baltimore office predicated upon the fact that your case is out of normal processing times. Good luck!
