I am still trying to figure out this filing process. I am a US citizen and I filed for my mother who lives in Jamaica June of this year. The case was approved this month, she was on vacation with me here in the USA so I had her signed a form making me the agent of the case. The letter also required me to pay $88 for affidavit of support processing, which I paid two weeks ago. The lastnight I received an email saying that I need to pay a visa fee of $404. My questions are:

1. Is this the last fee that I will need to pay?

2. My mom has a 17 year old son, can he be added to her case now? Based on this info:

4. Children who pass 21 years of age after the petition was originally approved by the USCIS become

ineligible to accompany or join the applicant(s) immigrating to the United States under the original

petition. In some situations, the Child Status Protection Act (CSPA) may allow children to remain

eligible beyond 21 years of age. If you believe that the CSPA applies to this case, please send a

detailed explanation to the NVC. We will forward it to the U.S. Embassy/Consulate for a decision.

1. Is this the last fee that I will need to pay? Yes but there will be other fees from your mom side such as medical fee & Police report

2. My mom has a 17 year old son, can he be added to her case now? Based on this info: You won't be able to add your brother to the case. You mom will have to file a separate I-130 for him once she gets into the country.

4. Children who pass 21 years of age after the petition was originally approved by the USCIS become

ineligible to accompany or join the applicant(s) immigrating to the United States under the original

petition. In some situations, the Child Status Protection Act (CSPA) may allow children to remain

eligible beyond 21 years of age. If you believe that the CSPA applies to this case, please send a

detailed explanation to the NVC. We will forward it to the U.S. Embassy/Consulate for a decision.

siblings aren't derivatives, meaning you would have to file separatly for your sibling. since it take a very long time for sibilings, it is better that your mom file for your brother.

the cspa is for derivatives.

if you would have filed for a married brother or sister, and they have children, your niece or nephew would be under the CSPA because they are derivatives, or if a USC parent filed for a married child with children, these are derivatives.

but siblings aren't derivatives, you file separate petitions for them, no matter how old they are.

Wat a gwaan my yute you've gotten far in your process and i know it went quickly you mom should be here in the next 2-3 months depending on when your case is completed.. but definately she will be completed by the END of Februart 2011 being that she currretly has her police report and all the necessary documents that are required along with the application for the visa.

IT's the last fee that you will pay to the NVC YES.. After this your mom will have 3 more payments to make as follows:

1. Payment for Police Certificate i think it was $2000.00 JMD when my mom and dad got theirs back in August 2010.

2. Medical Payment IF she does not have ANY medical records (shots) then she can expect to pay ABOUT $20,000 OR $230.00 USD ( that is with Medical Associates We eont use them again come next year when my brother has to do his medical di people dem not professional)

3. DHL delivery payment is required once approved JMD$800.00 OR USD$9.00(so mek sure she walk wit a gran to the interview).

About your 17 year old brother he wont be able to come - as is sorry. I also have a brother who is currently in Jamaica he's 15 y/o.. My mom & Dad were approved on November 1, 2010 and before or after he could not be added no current law will allow it.

Soulution given previously -

When your mom gets here submit an application for your brother and he will be reunited with her within 8-9 months so by Nov-Dec 2011 if things are done right...! Your MOM CAN still reside in Jamaica while the application IS pending regardless of what people here may say after this... she'll be required to travel within the 6 months of going back to Jamaica so she stays IN STATUS but shows she will migrate once the intending immigrant process is completed.
