My marriage to my K3 visa holder husband did not work. He took off on me and moved out with his K-4 [2] kids now 24 and 26 I sponsored. Out of anger and frustration every time he moved out, i decided not to adjust his status and requested ongoing process be cancelled. I didn't get my divorce until 7 years later due to financial hardship. He's resurfaced in my life and told me has been working as an illegal alien for the past 4-5 years. I've had a change o heart and even though cannot do anything for him as a spouse, I was told that after 7 years of marriage, he can adjust his immigrant status. I want to help him but cannot afford an attorney. Does anybody know where do I start to make this request? Please help.

If you really want to help him and you don't have the money, why not have him provide the money for all the expenses? You said you've had a change of heart, so who was being irresponsible that cost the marriage to break ...you or him? If it was you then it makes sense if you want to make it right by helping him. If it was him, maybe, just maybe the whole reason he married you in the first place was for immigration purposes, as is now. If the latter is the case ...you should know you are being used! :no:

He can only adjust status bsed upon marriage to you.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

OP, after all he has done to you you are willing to help him out? Sorry, you're divorced, for him to get any benefits you'd have to get married again and then convince the USCIS you're in a real marriage and you're not doing this so he can get a green card. That alone is your issue.

My advice - let it go and don't do anything for your ex.

There's nothing you can do now. The adjustment of status would need to have been filed and the green card issued while you were still married. He ceased to be eligible to adjust status when you divorced. If his last entry into the US was with the K3 visa then he's screwed - he can't adjust status by any means OTHER than marriage to you. The only exceptions are VAWA and asylum. VAWA would require that he accuse YOU of abuse or cruelty, and further prove the abuse or cruelty was the primary reason for the divorce. Asylum is a non-starter in the overwhelming majority of cases.

He's doing a lot of things to make up for the heartbreak and past mistakes - from the distance, of course. He's had to do hard labor work - as illegals do [holds an engineering degree from his home country] - for the past 5 years and for a man in his late 50s, it's starting to deteriorate his health. And I'm 100% that friendship is all I ever want with him. Not a relationship again. However, I still want to help him adjust his immigrant status even if i never see him again. Someone told me that after 7 years there is a clause in the immigration law that could allow him to obtain legal US residency, eventually. Otherwise, he's prepared to leave the country permanently in a couple of months.

Thanks all - it's October 2011 - almost a year later and just found out ex is heading back to his home country. My stand is still the same as of a year ago. Don't want any marital relationship with him - only friendship but i feel he's really paid his dues. He's worked nothing but hard labor and has endured pretty detrimental work conditions as all illegals. However, I still feel i want to help him get papers and let him go about his future the way he chooses. He's been a lot of help to me these last couple of years on and off whenever i needed major and minor home repairs. He's really hit rock bottom and something in my heart wishes to see him go his way but with his immigrant status adjusted. I have a couple of weeks left to see how i can help him see a way for a return to the US in the future. Thanks to all and at times, I have really identified with your replies and feelings about false people. I think some people come a long way and do change and if so, perhaps they need a chance to prove themselves otherwise. Don't want to be left with the feeling i could have done something to help somebody better his immigrant status/life without having to remarry him. take care ya'll

This has been explained previously in this thread. Someone who entered with a K3 visa can only adjust status based on marriage to the K3 petitioner. There are very few exceptions, and you could not help him with any of them.
