CR-1 Visa Denied in Colombia,Please Help!!

Timeline

Hello,I apply for my wife and my step daughter's papers like a 1 year and half ago ,with Cr-1 process.They received an interview i the Colombian embassy in Bogota last June,and when we went to the interview, the visa was denied,because the counselor considered that my marriage was a fraud,he didn't give me the reason why he denied then the visa.My wife and me considered that probably we didn't coincided on some of the question that the consul made to us. He made me sign a withdraw of my I-130,because he repeatedly insist that my wife and me made a fraud. After 2 months I received a letter from the Department of land security,canceling my wife and my stepdaughter's I-130.My question is Can I apply again for another I-130? If they get another interview the application that was denied will affect my new application? what is the best way to bring mu family to USA? I'm an honest us citizen that wants to reunified my family,and I would never do something illegal.Please give me your advise,or if you know any lawyer specialized on visa denies that could help us? What can I do at this point? Thank you for your help

i feel so bad about your situation. . .i mean if your marriage is authentic why would they deny it. . where did you guys get married? my aunt had the same situation as yours and they got approved, they were only married less than a year and they got approved. . .you should probably get an appeal, and a lawyer, i hope everything turns out well for you don't lose hope. . .

Normally, you can re-apply no problem, but should probably spend some time first removing the problems that got you denied (eg. make more visits, co-mingle finances,k tell eachother more about your lives so you can answer questions etc). However, I'd be concerned about the paper you signed, it could be an admission of material miss-representation.

What exactly did you sign and what did the paper you received about the cancelation say? Did the stamp/ write anything into your wife's passport?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

By US law the consular officer has to give you a written reason for refusal. I posted a form on a thread not long ago that states what officers have to do and what your rights are. I have not been schooled on any appeals process but since the DHS closed the I-130s then I would assume you would have to begin at that point again. As for hiring a lawyer I won't get into mentioning any specific lawyer but I would suggest if you go this way then you find one who specializes in immigration issues. A lawyer from a phone book that does accidents, divorces, duis and immigration I firmly believe are not properly trained to handle immigration issues. Look for one, and there are many very good ones, who specialize and, especially, limits their practice to immigration law. Good luck.

I agree with many people here, get a lawyer, most of the cases that I saw denied the day of my interview were cus of not enough proofs. and I wish you the best!!

What exactly did you sign and what did the paper you received about the cancelation say? Did the stamp/ write anything into your wife's passport?
This is the key information that needs to be clarified before anyone here can even recommend that you consult an immigration attorney. Signing a withdrawal of a petition is one thing; signing a withdrawal and admitting to fraud (if that's also what the paper said) is quite another.

Clarify the above, then consider consulting Foster & Quan at www dot fosterquan dot com. Very responsive, large, capable law firm that helped me considerably.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
