Help! I am confused. Instructions for both forms state in one section:

If you provide a photocopy of your tax return(s), you must include a copy of each and every Form W-2 and Form 1099 that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.

Then there is a Check List section that says:

The following items must be submitted with Form I-864 (or I-864EZ):

A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file. Also include a copy of each and every Form 1099,Schedule, and any other evidence of reported income.

So in they say in one section do not include copies of W-2s and 1099s if you send an IRS transcript, but then in the check list section they say you "must" include them and do not mention transcripts.

Has anyone just sent transcripts? Not sure what to do since I have the transcripts. Should I send the W-2s as well? At least for the most recent tax year?

I agree that one does not need to send in your schedules that you used to file for 2009 with the IRS transcripts;however, you can send the w-2's, 1099's if you want. I am sending my 2009 IRS tax transcripts with the w-2's and all supporting scgedules that I used when filing my 2009 taxes. I do not think that would hurt at all. I got the copy of the w-2's and schedules that my employer sent to the IRS directly from the IRS. Have you thought of getting a letter from your employer, if applicable, to validate your 2010 employment? If you already mentioned the employment letter, please excuse me. I wish you great success in your process. You can call the NVC for further clarification, as well. You will have a long wait time, but if you speak to them, you may feel more at ease.

If the income that you are documenting is ONLY yours, IRS tax transcripts are alone.

However, if you have combined with any others and you are the only sponsor, NVC/Consulate need to know ONLY your income. In this case W2/1099 with 1040 and schedules will help.

In my case, since I am the sponsor and my returns have only my income, I just sent tax transcripts.

I ended up sending past 3 years IRS transcripts and letter of employment with current salary. Used the I-864EZ since I am above the requirements with income alone.
