Hi guys,

I applied for my adjustment on status (I-485) along with my working authorization papers (I-765) and travelling documents (I-131) on September 13th. On September 22 I got NOA for all 3 documents. On November 12 I got my AP, but only today got my biometrics appoinment (for December 17)...Which is pretty much nearly 3 months after I got my NOA. Is a rule of 90 days still applicable to get your working authorization or USCIS can take their sweet time revewing my documents? My petition is based on K-1 Fiance visa.

Thanks in advance!

It is a little more than 2 months. Christmas will be three months.

There is no "rule" as to when they MUST issue anything. There is a guideline they try to follow and are subject to inquiry if they don't. IF they are outside the timeline, then you can make an inquiry from your congress person.

Also, IF you filed the EAD and AP with the I-485 and did not pay a separate fee for them (as is allowed) the EAD is tied to the I-485. If there is some sort of delay or problem they have discovered with the I-485, the EAD will also be delayed. They could, for example, be preparing to issue an RFE and holding both applications but the AP had already been processed.
