Wow calling USCIS was unbelievably frustrating! What a waste of an hour on hold. lol. Please can someone answer this for me. We just sent off our K1 packet and am now in the process of getting everything that we made need for the interview (Juarez, Mexico...) Do they need Police Records from all countries he has lived in? I know not Mexico, as they don't have Police Records available (He is a Canadian Citizen, but Mexican Resident). We know how to get one from Canada, but he has also lived in Belize off and on for 10 years. (never 12 months consecutively though) Belize is not on the list of coutries that you don't need them from, but when we call the PD Headquarters in Belize, they want their fee in cash, they want him to bring his passport and they want him to submit 3 extra immigration photos. All reasonable, if we were actually in that country. When I called USCIS and somehow got an agent, she said that Police Records are never needed for K1 visa interviews. I find this hard to believe as I have seen it listed as a requirement through months of research online. Do we need to get Police Records (he has no actual "record") for the K1 interview? We just want to be prepared, and if so, how do you get it if you are not in the country? Sorry, My head is actually spinning from all of this. :help::help::help:

USCIS does not need ANY police records for the petition. He WILL need police records for the interview from ANY country in which he has lived for more than 6 months (cumulative) since the age of 16 for any reason (even as a non-resident student) This is a State Department rule for visa issuance, NOT a USCIS rule. Regardless of any expiration date on the certificate itself, the consulate will accept them for one year from when they are issued.

USCIS would be the wrong people to call about this, but yes, it is frustrating because they are not set up to answer your questions. There are instructions for you to read regarding that. If the country does not give police certificates (you mention Mexico does not) then he does not need one from that country.

FYI. USCIS never does "K-1 visa interviews" They do K-1 petitions and K-1 Adjustment of status interviews. USCIS has NOTHING to do with issuing visas. Police records are not needed for ANYTHING that USCIS does regarding K-1 visas.

Police records ARE needed for the visa APPLICATION interview which is done by the Department of State.

There are THREE steps to the K-1 process. Petition, visa application, Adjustment of Status. USCIS handles steps 1 and 3. The police certificates are needed for step 2, handled by DOS.
